SALT LAKE CITY ORDINANCE

(Temporarily closing a portion of 1000 West Street between South Temple Street and
approximately 15 South 1000 West)
An ordinance temporarily closing a portion of 1000 West Street between South Temple
Street and approximately 15 South 1000 West, pursuant to Utah Code Section 72-5-105.
WHEREAS, a portion of 1000 West Street between South Temple Street and
approximately 15 South 1000 West intersects four at-grade rail crossings controlled by Patriot
Rail and Union Pacific rail lines, one of which is ungated (the “Subject Crossing”); and
WHEREAS, the Subject Crossing is included in the Woods Cross Quiet Zone,
established by the Federal Railroad Administration; and
WHEREAS, on or about September 30, 2024 the Federal Railroad Administration
conducted an inspection of the Subject Crossing and other crossings within the Woods Cross
Quiet Zone and determined that existing safety systems and measures implemented within the
Woods Cross Quiet Zone are inadequate, that there is a substantial increase in risk to the public
due to the absence of a warning signal in the form of the locomotive horn, and that sounding the
horns should be implemented immediately whenever a locomotive approaches the Subject
Crossing; and
WHEREAS, based on these determinations, the Federal Railroad Administration has
therefore suspended the Woods Cross Quiet Zone; and
WHEREAS, Utah Code Subsection 72-5-105(3) allows a municipality to temporarily
close a class C road to mitigate unsafe conditions after following the procedures specified under
Utah Code Subsection 72-5-105(5), which requires the city to hold a public hearing on the

temporary closure and provide notice of the proposed closure to the Utah Department of
Transportation; and
WHEREAS, the city has complied with the procedures set forth in Utah Code Subsection
72-5-105(5); and
WHEREAS, the abutting property owners are supportive of this temporary closure and
the efforts to mitigate the unsafe condition; and
WHEREAS, the Salt Lake City Council finds after holding a public hearing on this
matter, that there is good cause for the temporary closure of the portion of 1000 West Street
described herein to mitigate the unsafe conditions caused by the deficient safety systems at the
Subject Crossing.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Temporarily Closing a City-Owned Right-of-Way. That a portion of 1000
West Street, and which is more particularly shown on Exhibit “A” attached hereto, is hereby
temporarily closed as a public right-of-way pursuant to Utah Code Section 72-5-105 for the
period described in Section 2 below and is declared not presently necessary or available for use
as a public right-of-way during that period.
SECTION 2. Temporary Closure Period; Reopening. In anticipation of the planned
improvements to the Subject Crossing and measures to restore the Woods Cross Quiet Zone, the
portion of 1000 West Street described herein shall be closed as a public right-of-way from the
effective date of this ordinance until two years thereafter or thirty (30) days after mitigation of
the unsafe conditions is completed, whichever occurs first. Upon the conclusion of the temporary

closure period, the mayor shall direct that the portion of 1000 West Street described in Exhibit
“A” hereto shall be reopened and all obstructions to vehicular traffic removed.
SECTION 3. Effective Date. This Ordinance shall become effective on the date of its
publication.
