HomeMy WebLinkAbout059 of 2025 - Alley Vacation at 1470 East 1300 SouthSECTION 1. Vacating City-Owned Alley. That an unnamed city-owned alley, which is more particularly described on Exhibit "A" attached hereto, hereby is vacated and declared not presently necessary or available for public use. SECTION 2. Reservations and Disclaimers. The above vacation is expressly made subject to all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of this alley, and also subject to the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the city's water and sewer facilities. Said vacation is also subject to any existing rights-of-way or easements of private third parties. SECTION 3. Condition. This alley vacation is conditioned upon its disposition being consistent with the method of disposition set forth in Section 14.52.040. SECTION 4. Effective Date. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The city recorder is instructed not to publish or record this ordinance until the condition identified above has been met. SECTION 5. Time. If the condition identified above has not been met within one year after adoption, this ordinance shall become null and void. Prior to such one year period, the City Council may, for good cause shown, by resolution, extend the time period for satisfying the condition identified above. Here is my previous explanation for Thais: Salt Lake City Code provides the following: 14.52.040: METHOD OF DISPOSITION: If the City Council grants the petition, the City owned alley property will be disposed of as follows: A. Low Density Residential Areas: If the alley property abuts properties which are zoned for low density residential use, the alley will merely be vacated. For the purposes of this section, "low density residential use" shall mean properties which are zoned for single-family, duplex or twin home residential uses. The alley being vacated in this one does abut Low Density Residential areas. Consequently, once the ordinance is approved, the alley is deemed "vacated." As a result, the conditions in the ordinance have been met, therefore, the Recorder's Office may publish the ordinance. This vacation also abuts a low density residential area, specifically R-1-5000 (Single- Family Residential). Let me know if you need anything else. Courtney, I am wondering if you could provide some help with the condition listed in Ordinance 59 of 2025 Alley Vacation at 1470 East 1300 South, adopted last Tuesday 10/7 (also attached for reference). According to the condition in the ordinance, “This alley vacation is conditioned upon its disposition being consistent with the method of disposition set forth in Section 14.52.040.” We have encountered a previous alley vacation in which this seemed to be similar. In Ordinance 26 of 2025 - Alley Vacation Near 2680 S Chadwick from May, the condition was the same. With that one, the alley being vacated abutted to Low Density Residential and according to SLC Code, once the ordinance was approved, the alley was vacated and the conditions had been met and therefore the Recorder’s Office was able to publish the ordinance. Would this case be similar to that one and if so, may we publish the Ordinance in accordance with the satisfaction of the condition?
