HomeMy WebLinkAboutLegislative Version Ordinance - 5/19/2026LEGISLATIVE COPY 2026.05.15.PUD.Title17.Legis SALT LAKE CITY ORDINANCE No. ______ of 2026 (An ordinance amending Sections 17.16.670, 17.16.680, and 17.72.030, and repealing Section 17.64.060) WHEREAS, the Salt Lake City Department of Public Utilities completed a 1 comprehensive water, wastewater, and stormwater rate study and continues to evaluate 2 the structure of utility rates and charges to ensure revenue sufficiency, fairness and 3 equity, economic efficiency, sustainability and predictability, clarity, cost allocation, and 4 affordability; 5 WHEREAS, the Salt Lake City Council adopts utility fees, rates, and charges 6 through the Salt Lake City Consolidated Fee Schedule; 7 WHEREAS, the City Council further finds that certain definitions and billing 8 provisions in Title 17 should be updated to reflect current billing practices and customer 9 classifications; 10 WHEREAS, the City Council determines that the amendments set forth in this 11 ordinance are necessary and reasonable to promote the health, safety, and welfare of the 12 citizens of Salt Lake City; and 13 WHEREAS, the City Council of Salt Lake City, Utah, desires to repeal Section 14 17.64.060; and amend Sections 17.16.680, 17.16.670, and 17.72.030 of the Salt Lake City 15 Code. 16 NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: 17 SECTION 1. Amending the text of Salt Lake City Code Chapter 17.16 Article IX 18 (Rates and Payments). That Section 17.16.670 of the Salt Lake City Code (Minimum 19 Charges) shall be, and hereby is, amended to read as follows: 20 LEGISLATIVE COPY 2026.05.15.PUD.Title17.Legis 17.16.670: MINIMUM CHARGES: 21 22 Each customer shall pay the following minimum fixed charge shown on the Salt 23 Lake City Consolidated Fee Schedule, effective for all meter readings during the periods 24 from and including July 1, 2011, and thereafter until further amended, to cover costs 25 incurred to provide service. 26 27 SECTION 2. Amending the text of Salt Lake City Code Chapter 17.16 Article IX 28 (Rates and Payments). That Section 17.16.680 of the Salt Lake City Code (Meter Rates) 29 shall be, and hereby is, amended to read as follows: 30 17.16.680: METER RATES: 31 32 Each customer shall pay for each hundred cubic feet of water supplied through such 33 customer's meter, effective for all meter readings during the periods from and including 34 July 1, 2011, and thereafter until further amended, at the rates shown on the Salt Lake 35 City consolidated fee schedule. 36 37 SECTION 3. Amending the text of Salt Lake City Code Chapter 17.64 (Fees and 38 Charges). That Chapter 17.64 of the Salt Lake City Code shall be, and hereby is, 39 amended to repeal Section 17.64.060 (Annual Notification of Rates and Charges) in its 40 entirety. 41 17.64.060: ANNUAL NOTIFICATION OF RATES AND CHARGES: 42 43 Each user will be notified, at least annually, in conjunction with a regular bill, of the rate 44 and that portion of the user charges which are attributable to wastewater treatment 45 services. (Ord. 36-93 § 10, 1993: prior code § 37-6-2(8)) 46 47 SECTION 4. Amending the text of Salt Lake City Code Chapter 17.72 48 (Schedules). That Section 17.72.030 of the Salt Lake City Code (Schedule 1; Rates and 49 Fees) shall be, and hereby is, amended to read as follows: 50 17.72.030: SCHEDULE 1; RATES AND FEES: 51 52 A. Purpose: For the purpose of defraying the cost of construction, reconstruction, 53 maintenance and operation of the city sewer system, there are hereby imposed the 54 charges shown on the Salt Lake City Consolidated Fee Schedule upon all persons and 55 premises receiving sewer collection and treatment services. 56 LEGISLATIVE COPY 2026.05.15.PUD.Title17.Legis 57 B. Definitions: 58 59 AVERAGE WINTER CONSUMPTION: The average monthly water usage for a 60 residential customer during the consecutive months of December, January, and February, 61 used to calculate residential sewer charges for the twelve (12)-month period beginning on 62 July 1 immediately following such months. For a new account, or upon a change in 63 ownership or customer, the monthly sewer rates shall be based on the average winter 64 consumption for comparative users as shown on the Salt Lake City Consolidated Fee 65 Schedule. The average monthly water usage for residential customers for the consecutive 66 months of December, January, and February, which is the basis for residential sewer 67 billings for the twelve (12)-month period beginning July 1 immediately following such 68 months. 69 70 CUSTOMER CLASS: The classification or classifications applicable to each 71 customer of the sewer system for purposes of calculating such customer's service charge 72 under this chapter. 73 74 DUPLEX: A single building, property, premise, or structure containing two (2) 75 independent dwelling units served by a single sewer account. 76 77 DWELLING UNIT: A building or other structure or portion thereof, in which: (1) 78 an individual resides as a separate housekeeping unit, or (2) a collective body of persons 79 (doing their own cooking) resides as a separate housekeeping unit in a domestic bond 80 based upon birth, marriage, domestic employment or other family relationship, as 81 distinguished from a boarding house, lodging house, club, fraternity, motel or hotel. 82 83 MONITORED CUSTOMER: Non-residential customers designated by the 84 director and subject to routine sample measurements of the customer's wastewater flow 85 and/or discharge characteristics. 86 87 MULTI-FAMILY RESIDENTIAL: Any building, property, premise, or other 88 structure having four (4) or more residential dwelling units, including a mobile home 89 park, served by a single sewer account. 90 91 NON-RESIDENTIAL: Any building, property, premise, or structure that is not 92 classified as Residential or Multi-Family Residential under this chapter. Buildings used 93 for uses other than residential purposes. 94 95 RESIDENTIAL: Buildings, dwelling units, properties, premises, or structures 96 used for residential purposes, including single dwelling units, duplexes, and triplexes, but 97 excluding Multi-Family Residential structures, buildings, properties, or premises. 98 Buildings or dwelling units used to house people or persons for residential purposes, 99 including single dwelling units, duplexes, and triplexes, and excluding multi-family 100 residential structures or buildings. 101 102 LEGISLATIVE COPY 2026.05.15.PUD.Title17.Legis SERVICE CHARGE: The charge for sewer collection and treatment services 103 levied on all users of the public sewer system, as calculated pursuant to this chapter. 104 105 SERVICE TO MULTIPLE BUILDINGS: Sewer service to multiple buildings 106 shall be governed the same as Section 17.16.200 of this title. 107 108 SINGLE DWELLING UNIT: A building containing one dwelling unit. 109 110 TRIPLEX: A single building, property, premise, or structure containing three (3) 111 independent dwelling units served by a single sewer account. 112 113 UNMONITORED CUSTOMER: Any non-residential customer not designated as 114 monitored. 115 116 C. Sewer Charges: 117 118 1. a. Each residential sewer customer shall be charged the applicable monthly 119 sewer service charge set forth in the Salt Lake City Consolidated Fee Schedule, 120 consisting of the fixed monthly charge and, where applicable under the Consolidated Fee 121 Schedule, a flow rate charge based on the customer's average winter consumption. Each 122 residential sewer customer shall be charged a monthly service charge equal to the fixed 123 monthly charge together with the flow rate of average winter consumption as shown on 124 the Salt Lake City consolidated fee schedule. 125 126 b. Each monitored non-residential customer shall be charged a monthly service 127 charge equal to the fixed monthly charge together with the monitored wastewater flow 128 measured during the billing period as shown on the Salt Lake City Consolidated Fee 129 Schedule. Charges for wastewater pollutants shall be billed as shown on the Salt Lake 130 City Consolidated Fee Schedule. 131 132 c. Each unmonitored Non-Residential customer and each Multi-Family 133 Residential customer shall be charged the applicable monthly sewer service charge set 134 forth in the Salt Lake City Consolidated Fee Schedule, consisting of the fixed monthly 135 charge and, where applicable under the Consolidated Fee Schedule, a flow rate charge. 136 Each unmonitored non-residential customer and each multi-family residential customer 137 shall be charged a monthly service charge equal to the monthly service charge together 138 with the flow rate per the Salt Lake City consolidated fee schedule. The monthly water 139 meter reading for sewer billing purposes shall be equal to 70 percent (70%) of total water 140 usage for the month. 141 142 d. In cases where little or no water is used during one or more of the winter 143 months such that the average metered usage during such winter months cannot be 144 reasonably assumed to reflect typical monthly usage for an account, the director may use 145 other consumptive information specific to such account to determine the average winter 146 consumption. 147 148 LEGISLATIVE COPY 2026.05.15.PUD.Title17.Legis e. Meter readings for sewer billing purposes shall only include meters which 149 measure water entering the sewer system. 150 151 ef. In the case of sewer users whose water usage is based in whole or in part on 152 water sources other than the city, the city may require installation of a city-approved 153 meter, at the sewer user's expense, on the well(s) or other sources of water supply. 154 155 fg. For each single-family dwelling sewer user using water other than city water 156 and desiring not to install a water meter as provided above, the director may waive the 157 meter requirement, in which event the user will be charged for sewer service as provided 158 in subsection E of this section. 159 160 D. Metering of Sewage Flows: 161 162 1. Meters will be allowed in sewer lines when the user is permitted or required by 163 the director to have the sewage flow measured. 164 a. The charges for sewer service will be based upon the actual sewer meter 165 readings rather than average winter consumption or adjusted water meter readings. 166 b. The user shall furnish, install, and maintain at the user's expense a meter 167 pursuant to the city’s standards and specifications. 168 169 E. New Sewer Accounts: 170 171 1. For new residential sewer accounts, until the data required by subsection C1a 172 of this section is available, the monthly sewer rates shall be based on the average winter 173 consumption for comparative users as shown on the Salt Lake City Consolidated Fee 174 Schedule. 175 a. For monitored and unmonitored non-residential customers, new accounts shall 176 be treated in the same manner as established accounts under subsections C1b and C1c, 177 respectively, of this section. 178 179 SECTION 7. Publication. That a copy of the amended Salt Lake City Code shall 180 be published on the official Salt Lake City website. 181 SECTION 8. Effective Date.
