AN ORDINANCE. AMENDING TITLE 40, OF THE REVISED ORDINANCES OF
SALT LAKE CITY, UTAH, 1965, BY ADDING THERETO A NEW CHAPTER 2
RELATING TO CENTRAL BUSINESS IMPROVEMENT DISTRICT TAX.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Title 40 of the Revised Ordinances of Salt
Lake City, Utah, 1965, be, and the same hereby is, AMENDED by
ADDING a new Chapter 2 to read as follows:
Chapter 2
CENTRAL BUSINESS IMPROVEMENT DISTRICT TAX
Sections:
40-2-1. Title.
40-2-2. Purpose.
40-2-3. Central business improvement district tax.
Sec. 40-2-1. Title. This ordinance shall be known as the
"Central Business Improvement District Tax Ordinance of Salt Lake
City".
Sec. 40-2-2. Purpose. It is the purpose of this ordinance
to provide the City with a source of revenue for the funding of
the Central Business Improvement District to be utilized as
hereinafter provided.
Sec. 40-2-3. Central business improvement district tax.
(1) There is hereby levied upon each business located within the
area of the Central Business Improvement District established by
Resolution No. 19 of 1982, a tax for each year, or portion
thereof, in an amount equal to the license fee levied pursuant to
Section 20-3-2 of these revised ordinances in effect as of the
effective date of this ordinance.
(2) The tax imposed by this section shall be collected in
the same manner as the license fee imposed by Section 20-3-2 of
these revised ordinances and shall be governed by all applicable
sections of these revised ordinances pertaining thereto.
(3) The tax levied by this section shall be in addition to
all other taxes imposed upon a business located in the said
district.
(4) The tax imposed by this section shall be due and
payable on or before March 1, 1982 and on or before January 1, of
each following calendar year. In the event such fee is not paid
on or before such date, a penalty shall be assessed as provided
in Section 20-1-13 of these revised ordinances, which penalty
shall become part of the tax imposed by this section.
(5) All taxes collected pursuant to this section and any
income delivered from their investments, shall be deposited into
a special fund known as the "Central Business Improvement
District Fund".
(6) This special fund shall be utilized to pay the expenses
of the District and for no other purpose except upon disestab-
lishment of the District. In the event of disestablishment, any
funds remaining after payment of all liabilities of the District
shall be deposited into the General Fund of the City.
(7) Receipts from this special tax may be expended for the
general promotion of business activities within the District for
the benefit of the businesses assessed within the District.
SECTION 2. This Ordinance shall take effect upon the date
of its first publication.
