018 of 2004 - Regarding places of worship; Petition No. 400-03-22 0 04-1 • 0 04-5 SALT LAKE CITY ORDINANCE No. 18 of2004 (Amending regulations in the Salt Lake City Code concerning places of worship and making other related changes) AN ORDINANCE AMENDING THE REGULATIONS CONTAINED IN THE SALT LAKE CITY CODE REGARDING PLACES OF WORSHIP AND MAKING OTHER RELATED CHANGES,PURSUANT TO PETITION NO.400-03-22. WHEREAS,the Planning Commission and the City Council have held public hearings and have taken into consideration citizen testimony,filings,and demographic details of the area,the long range general plans of the City,and any local master plan as part of their deliberations. Pursuant to these deliberations,the City Council has concluded that the proposed amendments of the Salt Lake City Code are in the best interest of the City. NOW,THEREFORE,be it ordained by the City Council of Salt Lake City,Utah: SECTION 1. Section 6.08.120.B.5 of the Salt Lake City Code shall be and hereby is enacted to read as follows: 5. A legally existing Class F beer/brewpub,Class F beer/microbrewery, Class B private club,Class C beer/tavern license,as defined in section 6.08 of City Code,shall not be deemed nonconforming for purposes of expansion,reconstruction or licensing(as long as the use is permitted in the base zoning district)if the only reason for such non conformity is the subsequent location of a school,church or park within the spacing requirements. The subsequent location of a school,church or park within the spacing requirements of a brewpub,microbrewery,tavern or private club shall be deemed to be a waiver of spacing requirements as specified under city ordinances. SECTION 2. The"Table of Permitted and Conditional Uses for Commercial Districts,"located at Section 21A.26.080 of the Salt Lake City Code shall be and hereby is amended to indicate that places or worship shall be conditional uses in the Neighborhood Commercial (CN) zoning district. SECTION 3. The "Table of Permitted and Conditional Uses for Manufacturing Districts," located at Section 21A.28.040 of the Salt Lake City Code, shall be and hereby is amended to indicate that places of worship shall be a conditional use in the Manufacturing (M-1) zoning district. In addition, the list of qualifying conditions located at the end of that table shall be and hereby is amended to include the following text: 5. If a place of worship is located within 600 feet of a tavern,private club, brewpub or microbrewery, a written waiver of spacing requirements is required as a condition of approval. SECTION 4. The "Table of Permitted and Conditional Uses for Special Purpose Districts," located at Section 21A.32.140 of the Salt Lake City Code shall be and hereby is amended to indicate that places of worship shall be permitted uses in the Research Park (RP) and Business Park (BP) zoning districts. SECTION 5. Section 21A.38.160 of the Salt Lake City Code shall be and hereby is enacted to read as follows: 21A.38.160 Non-conformity of Taverns Brewpubs Microbreweries or Private Clubs A legally existing brewpub, microbrewery,private club, or tavern license, as defined in section 6.08 of City Code, shall not be deemed nonconforming for purposes of expansion, reconstruction or licensing(as long as the use is permitted in the base zoning district) if the only reason for such non-conformity is due to the subsequent location of a school, church or park within the spacing requirements as specified under city ordinances. SECTION 6. Effective Date.
