002 of 2017 - Amending the zoning map pertaining to a parcel located at 1975 Fortune Road to rezone the parcel fro 0 17-1 P 16-32 SALT LAKE CITY ORDINANCE No. 2 of 2017 (Amending the zoning map pertaining to a parcel located at 1975 Fortune Road to rezone the parcel from M-1 Light Manufacturing District to M-2 Heavy Manufacturing District) An ordinance amending the zoning map pertaining to a parcel located at 1975 Fortune Road to rezone the parcel from M-1 Light Manufacturing District to M-2 Heavy Manufacturing District pursuant to Petition No.PLNPCM2015-00128. WHEREAS,the Salt Lake City Planning Commission held a public hearing on February 10,2016 on an application submitted by Craig Thatcher of Thatcher Chemical("Applicant")to rezone property located at 1975 Fortune Road(the"Property")from M-1 Light Manufacturing District to M-2 Heavy Manufacturing District pursuant to Petition No.PLNPCM2015-00128; and WHEREAS,at its February 10,2015 meeting,the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said application with a recommendation that the city council require Applicant to enter into a development agreement with the city to restrict the use of the Property to those uses presently allowed in the M-1 Light Manufacturing District along with loading and unloading facilities as described in the Planning Division Staff Report dated February 10,2016;and WHEREAS,after a public hearing on this matter the city council has determined that adopting this ordinance is in the city's best interests. NOW,THEREFORE,be it ordained by the City Council of Salt Lake City,Utah: SECTION 1. Amending the Zoning Map. The Salt Lake City zoning map,as adopted by the Salt Lake City Code,relating to the fixing of boundaries and zoning districts,shall be and hereby is amended to reflect that the Property located at 1975 Fortune Road(Parcel ID number 15-10-352-012), and as more particularly described on Exhibit"A" attached hereto, shall be and hereby is rezoned from M-1 Light Manufacturing District to M-2 Heavy Manufacturing District. SECTION 2. Condition. The zoning map amendment that is the subject of Petition No. PLNPCM2015-00128 described herein is conditioned upon Applicant entering into a development agreement with Salt Lake City Corporation to be recorded against the Property that restricts the use of said Property to uses currently allowed in the M-1 Light Manufacturing District along with loading and unloading facilities associated with current uses. SECTION 3. Effective Date. This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The city recorder is instructed not to publish or record this ordinance until the condition identified above has been met as acknowledged by the director of the Salt Lake City Planning Division. SECTION 4. Time. If the condition identified above has not been met within one year after adoption, this ordinance shall become null and void. The city council may, for good cause shown, by resolution, extend the time period for satisfying the condition identified above.
