WHEREAS, Salt Lake City has heretofore encouraged and approved the development of a park and, through the City's Redevelopment Agency, the construction of a housing project in the Jackson Target Area near 500 North and 700-800 West to further the revitalization of the Jackson Neighborhood within the Northwest Community of this City; and WHEREAS, the design process for said housing and park projects (which attempts to maximize the benefit of public land and minimize unnecessary expense) indicates goals of said projects and traffic circulation patterns can be better achieved if the public's interest in the street known as 500 North is redesigned and narrowed and portions of 500 North and 700 West are closed; and WHEREAS, the City's Planning Department in Petition No. 403 of 1981 proposes that to accomplish said purposes of furthering the projects and modifying traffic circulation patterns, that said roads be redesigned, narrowed or closed as follows; and WHEREAS, the Council finds that redesign, narrowing, g closure and/or vacation of portions of said streets as r.+� F-^ provided below will not have an adverse impact upon traffic C' circulations; but will result .in maximizing the utility of pia existing public resources. r3 i Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Redesign of 500 North 700-800 West and narrowing of paved way. That 500 West Street, as it lies between 700-800 West between Blocks 83 and 86 of Plat "C", Salt Lake City Survey, presently includes 132 feet within the right of way. The existing width of street improvements from curb to curb is approximately 66 feet. Said street and its street improvements shall be redesigned, and the width of the street improvements from curb to curb shall be narrowed to a width of approximately 36 feet. The width remaining within said right of way shall be retained as public property within the right of way and be made available for City and public use, including utilities, landscaping, sidewalks, etc. as deemed appropriate by the City according to specifications of the City Public Works and Parks Directors. It is antici- pated said oversized parking strip on the south side of 500 North Street may be incorporated into the extension of a City park on the south side of said street from Grant Street west to 800 West Street. SECTION 2. Narrowing of right of way of 500 North Street between 700 West and Grant Streets (Parcel 1) and closure of 700 West Street north of narrowed 500 North Street to I-15, (Parcel 2) . To achieve the goals of encouraging maximum use of public resources and the construction of the housing pro- ject by the redesign and narrowing of 500 North, there is created a strip of land on the north side of 500 North Street between Grant Street and 700 West Street of 45-53' in width: Said strip (Parcel 1) and 700 West Street north of 500 North (Parcel 2) , no longer shall be necessary for use as public thoroughfares. Said parcels, more particularly described o 0 below, are hereby declared to be CLOSED and no longer available Cn for use as public streets, avenues, alleys or pedestrian ways. However, said parcels hereby closed for use as streets are hereby reserved as City property which may be made available ° CA -2- for future zrcansfer to enlarge the housing project upon terms and conditions as the Mayor may deem appropriate. Parcel 1. 53 foot strip on north side of 500 North from Grant Street to 700 West Street. Beginning at the Southwest corner of Lot 35, Block 1, WILKES ISUBDIVISION, a subdivision of Block 86, Plat "C", ' Salt Lake City Survey; thence N. 89°54'03" E. 300.00 ;feet along the South line of said Block 86; thence S. V 04'17" W. 53.66 feet; thence S. 89°59'51" W. '" 229.838 feet to a point of curvature of 337.143 foot radius curve to the right; thence Northwesterly along the arc of said curve 70.956 feet; thence N. 0000'55" W. 45.789 feet to the point of beginning. It is hereby acknowledged that within said parcels - are existing water, gas, fuel, and other utility lines to i� presently in use, which will inhibit the City's or any py -3- successor-in-intcrest's ability to construct buildings upon said parcels. if it becomes necessary in the future for a successor-in-interest of the City to move, adjust, or otherwise adapt the location of said public utilities, such party shall be responsible to bear any and all expense of all proposed adaptations and their design and construction. Said party shall also be responsible to obtain the approval of the City upon proposed plans before any building or public work permits may be issued. 2. Both sides of 500 North Street from 700-800 West Street shall be restricted and marked to prohibit parking to accommodate access by emergency vehicles. 3. Failure by any successors-in-interest to the City to comply with all or any of the terms above shall be grounds for forfeiture of any interest based upon this legislative act. Any subsequent party remaining in default of said terms after thirty (30) days written notice of default given by the Mayor shall cause any interest subsequently transferred to revert to the City. Deputy / City Recorder of Sall-Lake City,Utah a 0 �c CA Ci4 a) W a r SALT LAKE CITY ORDINANCE No. 20 of 1982 = (Redesign, Narrowing and Closure of p ortign '� v of 500 North at 700-800 West and Closurefto .� 700 West north of 500 North to I-15) AN ORDINANCE PROVIDING FOR THE REDESIGN AND NARROWING OF THE PUBLIC STREET IMPROVEMENTS OF 500 NORTH AT 700-800 WEST; PROVIDING FOR THE NARROWING OF THE STREET WIDTH IN PORTIONS OF THE NORTH SIDE OF 500 NORTH FROM 700 WEST TO GRANT STREET; AND CLOSING A 55' STRIP ON THE NORTH SIDE OF 500 NORTH BETWEEN 700 WEST AND GRANT STREET TOGETHER WITH 700 WEST NORTH OF 500 NORTH, SUBJECT TO CERTAIN RESERVATIONS AND CONDITIONS SUBSEQUENT. WHEREAS, Salt Lake City has heretofore encouraged and approved the development of a park and, through the City's Redevelopment Agency, the construction of a housing project in the Jackson Target Area near 500 North and 700-800 West to further the revitalization of the Jackson Neighborhood within the Northwest Community of this City; and WHEREAS, the design process for said housing and park projects (which attempts to maximize the benefit of public land and minimize unnecessary expense) indicates goals of said projects and traffic circulation patterns can be better achieved if the public's interest in the street known as 500 North is redesigned and narrowed and portions of 500 North and 700 West are closed; and WHEREAS, the City's Planning Department in Petition No. 403 of 1981 proposes that to accomplish said purposes of furthering the projects and modifying traffic circulation patterns, that said roads be redesigned, narrowed or closed as follows; and 0 ca WHEREAS, the Council finds that redesign, narrowing, C+J closure and/or vacation of portions of said streets as Gr) provided below will not have an adverse impact upon traffic m circulations; but will result in maximizing the utility of f.► existing public resources. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Redesign of 500 North 700-800 West and narrowing of paved way. That 500 West Street, as it lies between 700-800 West between Blocks 83 and 86 of Plat "C", Salt Lake City Survey, presently includes 132 feet within the right of way. The existing width of street improvements from curb to curb is approximately 66 feet. Said street and its street improvements shall be redesigned, and the width of the street improvements from curb to curb shall be narrowed to a width of approximately 36 feet. The width remaining within said right of way shall be retained as public property within the right of way and be made available for City and public use, including utilities, landscaping, sidewalks, etc. as deemed appropriate by the City according to specifications of the City Public Works and Parks Directors. It is antici- pated said oversized parking strip on the south side of 500 North Street may be incorporated into the extension of a City park on the south side of said street from Grant Street west to 800 West Street. SECTION 2. Narrowing of right of way of 500 North Street between 700 West and Grant Streets (Parcel 1) and closure of 700 West Street north of narrowed 500 North Street to I-15, (Parcel 2) . To achieve the goals of encouraging maximum use of public resources and the construction of the housing pro- ject by the redesign and narrowing of 500 North, there is created a strip of land on the north side of 500 North Street between Grant Street and 700 West Street of 45-53' in width: Said strip (Parcel 1) and 700 West Street north of 500 North (Parcel 2) , no longer shall be necessary for use as public thoroughfares. Said parcels, more particularly described 0 x below, are hereby declared to be CLOSED and no longer available CCA for use as public streets, avenues, alleys or pedestrian ways. W However, said parcels hereby closed for use as streets are Y hereby reserved as City property which may be made available CkS -2- for future transfer to enlarge the housing project upon terms and conditions as the Mayor may deem appropriate. Contains 15,675.038 feet2 = 0.3598 acres. Parcel 2. 700 West north from 500 North to I-15. ;Beginning at the Southeast corner of Lot 44, Block 1, ; WILKES SUBDIVISION, a subdivision of Block 86, Plat "C", Salt Lake City Survey; thence N. 0°04'17" East 280.00 feet to the west N/A line of Interstate 15; thence S. 57°38'28" East 41.402 feet along said N/A line; thence S. 6°19'08" East 325.144 feet along said N/A line to a point on the arc of a 35.00 foot radius curve to the left; thence northwesterly along the arc ,,,of said curve 29.444 feet (long chord bears N. 65°54' 08" West 28.583 feet) to a point of tangency; thence (: ! S. 89°59'51" West 45.082 feet; thence N. 0100'09" West 153.66 feet to the point of beginning. Contains 16,809.354 feet2 = 0.3859 acres. SUBJECT TO THE FOLLOWING RESERVATIONS. Said CLOSURE is expressly made SUBJECT TO the reservation of all existing rights of way and easements of all public utilities of any and every description, found and located on, in, under or over the confines of the above-described properties; and also, SUBJECT TO the rights of entry thereon for the purpose of obtaining, altering, repairing, replacing, removing, or rerouting said utilities and all of them. Said CLOSURE is also SUBJECT TO any existing rights of way or easements of private third parties. SECTION 3. Conditions subsequent. The action approved in Sections 1 and 2 above in redesigning, narrowing and 0 closing portions of the streets described therein, is subject CA CJ to the following conditions subsequent and consideration for a) W this ordinance. I. It is hereby acknowledged that within said parcels are existing water, gas, fuel, and other utility lines Ca presently in use, which will inhibit the City's or any -3- successor-in-interest's ability to construct buildings upon said parcels. If it becomes necessary in the future for a successor-in-interest of the City to move, adjust, or otherwise adapt the location of said public utilities, such party shall be responsible to bear any and all expense of all proposed adaptations and their design and construction. Said party shall also be responsible to obtain the approval of the City upon proposed plans before any building or public work permits may be issued. 2. Both sides of 500 North Street from 700-800 West Street shall be restricted and marked to prohibit parking to accommodate access by emergency vehicles. 3. Failure by any successors-in-interest to the City to comply with all or any of the terms above shall be grounds for forfeiture of any interest based upon this legislative act. Any subsequent party remaining in default of said terms after thirty (30) days written notice of default given by the Mayor shall cause any interest subsequently transferred to revert to the City.
