020 of 2001 - amending chapter 21A.24.010 and related provisions of code regarding residential height standards an 0 01-1 0 00-4 SALT LAKE CITY ORDINANCE No. 20 of 2001 (Amending Chapter 21A.24.010 and Related Provisions of the Salt Lake City Code Regarding Residential Height Standards and Calculations of Grade) AN ORDINANCE AMENDING CHAPTER 21A.24.010 AND RELATED PROVISIONS OF THE SALT LAKE CITY CODE REGARDING THE RESIDENTIAL HEIGHTS STANDARDS AND CALCULATION OF GRADE, PURSUANT TO PETITION NO. 400-00-13. WHEREAS, the Salt Lake City Zoning Code contains regulations regarding the height of buildings in residential zoning districts, and regarding the calculation of grade; and WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearings before its own body and before the Planning Commission that portions of the Salt Lake City Code which relate to the height regulations of residential structures and the calculation of grade should be amended to protect the character and integrity of residential neighborhoods, and that such amendments are in the best interest of the City; NOW THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Section 21A.24.010.O.1.a. of the Salt Lake City Code shall be and hereby is amended to read as follows: O. Special Foothills Regulations: The FP Foothills Protection District, Section 21A.32.040 of this Part, and the FR-1/43,560, FR-2/21,780 and FR-3/12,000 Districts shall be subject to the regulations of this subsection, other general provisions for residential districts, and the district regulations of each district. 1. Special Building Height Controls: Uses and buildings in the FR-1/43,560, FR-2/21,780, FR-3/12,000 and FP Districts shall conform to the following special height regulations: a. Building height for initial construction of a building in a foothill zone shall be measured as the vertical distance between the top of the roof and the established grade at any given point of building coverage. Building height for any subsequent structural modification or addition to a building shall be measured from finished grade existing at the time a building permit is requested. Building height for foothills districts is defined and illustrated in, Part VI, Chapter 21A.62 of this Title. SECTION 2. Section 21A.24.010.O.1.e. shall be and hereby is amended to read as follows: e. All building heights for initial construction of a building in a foothill zone shall be measured from the established grade. Up to four feet (4') of fill (or 6 feet within the buildable area of the lot) may be added on top of the established grade in order to bring the exposed portion of the lower story of a single exterior wall of building into compliance with the definition of a basement when the majority of that lower level of that exterior wall already complies with this definition. The height of any subsequent structural modification or addition to a building shall be measured from the finished grade existing at the time a building permit is requested. SECTION 3. Section 21A.24.010.0 of the Salt Lake City Code shall be and hereby is amended to read as follows: U. Building Height Controls Based On Topography Outside Foothill Districts: The maximum height of single-family, two-family or twin home buildings and building additions or structural modifications on any sloping lot in any zoning district, may be measured as the vertical distance between the top of the roof and the finished grade at any given point of building coverage . The maximum building height, when determining height by this method, shall be the same as the maximum height for the FR-2 and FR-3 Zoning Districts. For the purpose of this Section, a lot shall be considered "sloping" if the average grade from side to side or front to back is 12% or greater. SECTION 4. The definitions contained in Section 21A.62.040 of the Salt Lake City Code shall be and hereby are amended as follows: "Building Height - Foothills Districts": In the FR-1, FR-2, FR-3 and the FP Districts, building height shall be the vertical distance between the top of the roof and the grade of the site, as described in Subsection 21A.24.010.O.1.a, measured at any given point of building coverage. Grade, Established: "Established grade" means the natural topographic grade of undisturbed areas on a site or the grade that exists after approved subdivision site 2 development activity has been completed prior to approval for building permit construction activity. Grade, Finished: "Finished grade" means the finished grade of a site after reconfiguring grades according to an approved re-grading plan related to the initial building permit activity on a site. SECTION 5. Illustration A, entitled "Building Height in Foothill Districts," located at Section 21A.62.050 of the Salt Lake City Code, shall be and hereby is amended as set forth on Exhibit"A" attached hereto. SECTION 6. Effective Date. This ordinance shall become effective on the date of its first publication.
