(Repairs and Replacement of
Sidewalks and Curb and Gutters)
AN ORDINANCE AMENDING SUBSECTIONS 38-2-1 (1 ) , 38-2-1 (3 ) (b) ,
and 38-2-1 (3 ) ( d) OF THE REVISED ORDINANCES OF SALT LAKE CITY,
UTAH, 1965, AS AMENDED, RELATING TO REPAIRS AND REPLACEMENT OF
SIDEWALKS AND CURB AND GUTTERS.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Section 38-2-1 of the Revised Ordinances of
Salt Lake City, Utah, 1965, as amended , relating to Repairs and
Replacement of Sidewalks and Curb and Gutters be, and the same
hereby is, amended as follows :
Sec . 38-2-1 (1 ) Purpose. This title is enacted for the
purpose of promoting the health, safety and welfare of the
inhabitants of Salt Lake City by keeping sidewalks, curb,
gutters , drive approaches and appurtenances such as parking bays
and carriage walks in safe useable condition. To this end it is
deemed the responsibility of owners to notify the City of any
defective concrete, existing at their property and upon
replacement of the defective concrete , to pay an amount equal to
the resulting benefit to the improved property.

(3 ) ( a) ***
( 3 ) (b) Appurtenances. "Appurtenances" shall mean
miscellaneous concrete surfaces within the Public Way such as
parking bays and carriage walks.
( c) ***
(d) Defective Concrete. "Defective Concrete" shall mean
the existence of any of the following conditions within the
Public Way:
( 1 ) Where sidewalk, curb, gutter, and driveway
approach sections or appurtenances have been displaced
either horizontally or vertically to a point that one
section or even a part of a section is separated at .least
one-half ( 1/2 ) inch from the other; or
(2) Where sidewalk, curb , gutter, and drive approach
sections or appurtenances have a minimum of three ( 3 ) cracks
of any length or width between score marks and/or expansion
joints; or
( 3 ) Where greater than twenty-five percent of the
surface area of any sidewalk, curb , gutter, and drive
approach sections or appurtenances is spalled , or
(4 ) Where sidewalk, curb , gutter, and drive approaches
or appurtenances have settled , spalled or have depressions
which allow water to become entrapped or causes ice pockets ;
or
( 5 ) Where sections of sidewalk, curb , gutter, and

drive approaches or appurtenances contiguous to sections
which are in a condition as defined in (1 ) , (2 ) , (3 ) , or (4 )
above, show similar signs of deterioration to such an extent
that they can reasonably be considered as part of the
overall defective areas or which must be replaced to effect
a proper correction of the defective sections .
( 6 ) A drawing illustrative of subsections ( 1 ) , ( 2 ) ,
(3 ) , (4 ) and (5) is adopted as part of this ordinance for
illustrative purposes only. Three ( 3 ) copies of the
defective concrete replacement criteria drawing shall be
kept on file in the City Recorder' s Office and in the City
Engineer's Office .

SECTION 2. This ordinance shall take effect thirty ( 30 )
days after its first publication .
