No . 36 of 1985
(Alley Vacation, Block 2, Oakley Subdivision)
AN ORDINANCE VACATING A 16 FOOT ALLEY IN BLOCK 2, OAKLEY
SUBDIVISON, AT APPROXIMATELY 1275 WEST AS IT RUNS SOUTH FROM 400
NORTH TO CLARK STREET.
RECITALS
The City Council of Salt Lake City, Utah, finds after
advertised public hearing, that the City's interests in the alley
described below which was platted within Block 2 of the Oakley
Subdivision is no longer necessary for use as a public way.
Vacation of said alley described below will not be adverse to the
interests of the City or the general public.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1 . ALLEY VACATION. That certain 16 foot alley
located in Block 2 of the Oakley Subdivision at approximately
1275 West between Oakley and 1300 West Streets which runs south
from 400 North to Clark Street in Salt Lake City, is the subject
of Petition No . 400-195 of 1984 submitted by Bertha Schmidt.
Said alley, more particulary described below, be, and the same,
hereby is, VACATED and declared no longer to be needed or
available for use as a public alley or public way:
Beginning at the northeast corner of Lot 11 , Block 2,
OAKLEY SUBDIVISION, a subdivision of part of Sections
26, 27, 34 and 35, T1N, R1W, Salt Lake Base and 1 `�
Meridian ; and running thence South 208. 6 feet, more or
less along the east line of Lot 11 extended to a point
on the East line of Lot 18; said point being the
Southeast corner of said Lot 18; thence South 70007'
East 17. 52 feet, to the West line of Lot 2 ; thence
North 214. 5 feet to the Northwest corner of Lot 10;
thence West 16.25 to the point of beginning .
EXPRESS RESERVATIONS
1 . Said vacation is expressly made SUBJECT TO all
existing rights of ways and easements of any and all
public utilities of any and every description now
located on, in, under, or over the confines of the
above described property; and also SUBJECT TO the
rights of entry thereon for the purpose of obtaining ,
altering , replacing , removing , repairing , or rerouting
said utilities and all of them.
2. Said vacation is also SUBJECT TO any existing
rights of ways or easements of private third parties .
SECTION 2. EFFECTIVE DATE. This ordinance shall take
effect thirty (30 ) days after the date of its first publication.
Passed by the City Council of Salt Lake City, Utah, this
14thday of May , 1985.
