(Adopting a biennial fiscal period and making related
amendments to the Salt Lake City Code)
AN ORDINANCE ADOPTING A BIENNIAL FISCAL PERIOD AND MAKING
RELATED AMENDMENTS TO THE SALT LAKE CITY CODE.
PREAMBLE
Section 10-6-105(2) of the Utah Code Annotated states that the legislative body of
a city may, by ordinance, adopt for the city a fiscal period that is a biennial period
beginning July 1 and ending June 30 of the second following calendar year. The statute
requires that each city adopting such an ordinance shall separately specify the amount of
ad valorum property tax it attends to levy and collect during both the first half and the
second half of the biennial budget. It is the intent of Salt Lake City to adopt such a
biennial fiscal period, and to comply with the mandate of the Utah legislature, but to
reserve in itself the power to amend the tax rates as may be necessary and appropriate.
SECTION 1. PURPOSE. The purpose of this ordinance is to adopt a biennial
fiscal period for Salt Lake City, pursuant to Section 10-6-105(2) of the Utah Code
Annotated, from July 1, 2001 through June 30, 2003, and continuing for subsequent
periods in the future.
SECTION 2. COMPLIANCE WITH STATE LAW. Pursuant to Section 10-6-
105(2)(c) of the Utah Code Annotated, the biennial budget adopted by the City shall
comply with Sections 59-2-912 through 59-2-926 of the Utah Code Annotated.
SECTION 3. FILING OF ORDINANCE. The City Budget Officer is hereby
authorized and directed to certify and file copies of this ordinance with the State Auditor
as required by Section 10-6-105(2)(d) of the Utah Code Annotated within ten (10) days
following the adoption of this ordinance.
SECTION 4. In accordance with the City's adoption of a biennial fiscal period,
the City hereby also adopts the following amendments to the Salt Lake City Code.
A. Section 2.04.010.E of the Salt Lake City Code shall be and hereby is
amended to read as follows:
E. Preparing the city budget and submitting the same to the
city council.
B. Section 2.52.020.A of the Salt Lake City Code shall be and hereby is
amended to read as follows:
A. An employment staffing document shall be adopted as
an element of the city's budget, or otherwise, as the city
council may require. Three (3) copies of such document
shall be filed for use and examination of the public in the
office of the recorder of the city prior to its adoption.
C. Section 2.80.120.H.5 of the Salt Lake City Code shall be and hereby is
amended to read as follows:
5. Appropriations by the council to the fund shall be
considered as part of the budget process.
D. The title to Section 3.32.100 of the Salt Lake City Code shall be and
hereby is amended to read as follows:
3.32.100 Budget expenditure.
E. The title to Section 3.36.090 of the Salt Lake City Code shall be and
hereby is amended to read as follows:
3.36.090 Budget expenditures.

F. Section 3.40.030.D of the Salt Lake City Code shall be and hereby is
amended to read as follows:
D. The sums due the city's general fund under this chapter
for each fiscal year after 1990-91 shall be determined by the
city's finance department following the city's
administrative policies and procedures and using audited
financial data. Each said enterprise fund shall be notified
of the pilot due in the city's budget, with payment due on or
before December 30th of each year,beginning in 1990.
G. Section 15.21.040.B of the Salt Lake City Code shall be and hereby is
amended to read as follows:
B. An estimate of all capital projects required in the next
three (3) fiscal years for the Recreation Enterprise Fund
shall be submitted by the Mayor to the City Council, with
each tentative budget.
SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on its first
publication.
