046 of 1987 - Rezone under Petition No. 400-516-87 [PRUNIG R SALT LAKE CITY ORDINANCE No . 6 of 1987i(Rezoning certain property at approxit o 900 South 200 East from "B-3" to "C-111 , 17//`_/ � pursuant to Petition No . 400-516-87 and imposing conditions subsequent ) AN ORDINANCE AMENDING SECTION 51-12-2 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, AS AMENDED, RELATING TO ZONING AND FIXING OF BOUNEARIES OF USE DISTRICTS. WHEREAS, in response to Petition No. 400-,4q-6=87 the City Council of Salt Lake City , Utah, has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony , filings, and demographic details of the area as part of its own deliberation. Pursuant to these deliberations, the Council has concluded that it is appropriate to rezone a parcel located at approximately the northeast corner of 900 South and 200 East from Business "B-3 " to Commercial "C-1" so long as certain conditions are complied with . Therefore, the City Council of Salt Lake City , Utah, hereby adopts the following amendment to the Use District provisions of Title 51. Be it ordained by the City Council of Salt Lake City , Utah: SECTION 1. That the Use District Map, as adopted by Section 51-12-2 , Revised Ordinances of Salt Lake City , Utah, 1965, as amended , relating to the fixing of boundaries of Use Districts , be, and the same hereby is, AMENDED as follows : Sec . 51-12-2 . BOUNDARIES OF USE DISTRICTS. That the following described parcel of property lying at the northeast corner of 900 South and 200 East be rezoned and the Use District Map amended as follows : Business "B-3 " to Commercial Commencing at the northeast corner of 900 South and 200 East Street, said point being the southwest corner of Lot 11 City Hall Subdivision, a subdivision of Block 1, Plat "A" , Salt Lake City Survey and running thence East along the North line of 900 South Street l 90. 0 feet; thence North 132. 5 feet to the centerline of an existing alley; thence West along the centerline of the alley 90. 0 feet to the East line of 200 East Street ; thence South along the East line of 200 East Street 132. 5 feet to the po int of beginning . SECTION 2. CONDITIONS SUBSEQUENT. Prior to the ordinance becoming effective petitioners shall: (1 ) Submit plans for the building to be constructed at the northeast corner of 900 South and 200 East and shall obtain the City' s final approval of such plans; ( 2 ) Remove all nonconforming signs from both parcels ; and (3 ) Plant acceptable street trees at the business location or , in the alternative , post a bond acceptable to guarantee the planting of the street trees after construction . SECTION 3. EFFECTIVE LATE. This ordinance shall become effective immediately upon publication. The City Recorder is instructed to not publish this ordinance until the Mayor -2- certifies that the conditions set forth in Section 2 above have been fully complied with. In the event such conditions are not complied with within a year the Mayor may extend the time for performance of the conditions for an additional year. If the conditions are not met as specified above this ordinance shall become of no effect and null and void . Passed by the City Council of Salt Lake City, Utah, this 14 day of July 1987.
