WHEREAS the City Council of Salt Lake City, Utah, finds after public hearing that the City' s interest in the public streets described below is not necessary for use by the public as streets and that vacation or closure of said streets with the reservation of certain easements and upon certain conditions will not be adverse to the general public' s interests; and further , the City' s interest in the private right-of-way is also no longer necessary for public use . NOW , THEREFORE, be it ordained by the City Council of Salt Lake City , Utah: SECTION 1. Said dis- closure is SUBJECT TO any existing rights-of-way or easements of private third parties. SECTION 5. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication. The City Recorder is instructed to not publish this ordinance until and unless the Mayor shall certify that an Urban Development Action Grant from the Department of Housing and Urban Development has been preliminarily granted to provide for the development of the property surrounding these vacated streets and easements. The City Recorder is further instructed to not publish this ordinance until Petitioner provides appropriate guarantees for payment of the cost of the closed portion of Brazier Court in a form CD acceptable to the City Attorney. In the event the conditions are not met within a year this ordinance shall be void and of no Kj IV effect and the City Recorder is instructed not to publish it.
