048 of 2009 - Amending a portion of Section 21A.32.140, (Table of Permitted and Conditional Uses for Special Purpo 0 09-1 0 09-27 SALT LAKE CITY ORDINANCE No. 48 of 2009 (An ordinance amending a portion of section 21A.32.140 of the Salt Lake City Code to allow public parks in the Public Lands zoning district) An ordinance amending a portion of section 21A.32.140 (Table of Permitted and Conditional Uses For Special Purpose Districts) of the Salt Lake City Code pursuant to Petition No. PLNPCM2009-00616 to allow public parks in the PL(Public Lands) zoning district. WHEREAS, the Salt Lake City Planning Commission ("Planning Commission") held a public hearing on June 24, 2009 to consider a request made by Salt Lake City Mayor Ralph Becker(petition no. PLNPCM2009-00616) to amend section 21A.32.140 of the Salt Lake City Code to amend a portion of section 21A.32.140 (Table of Permitted and Conditional Uses For Special Purpose Districts) of the Salt Lake City Code to allow public parks in the PL (Public Lands) zoning district; and WHEREAS, at its June 24, 2009 hearing, the Planning Commission voted to transmit a positive recommendation to the Salt Lake City Council ("City Council") on said application; and WHEREAS, after a public hearing on this matter the City Council has determined that the following ordinance is in the City's best interests, NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Amending text of Salt Lake City Code section 21A.32.140. That the table, titled "Table of Permitted and Conditional Uses For Special Purpose Districts", which is located at section 21A.32.140 of the Salt Lake City Code shall be, and hereby is, amended to indicate that public parks are a permitted use in the PL(Public Lands) zoning district, such that the inserted provision shall appear and read as follows under the category of recreation, cultural and entertainment uses: Permitted And Conditional Uses Use RP BP FP AG AG- AG- AG- OS NOS A PL PL- I UI MH El MU 2 5 20 2 Recreation, cultural and entertainment: Amphitheaters C Arenas, stadiums, C C C fairgrounds Art galleries P P Art studio P Botanical gardens C C Commercial indoor C recreation Community gardens as P defined in chapter 21A.62 of this title Country clubs P Dance studio P Golf courses P P P Movie theaters/live C C performance theaters Museums C P P PP P Music conservatory P Natural open space and P P P ` P P P9 P conservation areas Nature PPP P P P P9 P preserves/conservation areas, public and private Park (public) C P P P P P Pedestrian pathways, trails P P and greenways Performing arts production P facility Private recreational P P P P P facilities Tavern/lounge/brewpub; C 2,500 square feet or less in floor area Zoological park P 2 SECTION 2.
