049 of 1982 - Street Closure South Temple to 100 South Street - Salt Palace Expansion Project C. r ��� OF�LMED condition::; Prot Met 0 82 16 ��VV�� Void Ordinance SALT LAKE CITY ORDINANCE No. 49 of 1982 (Closing and narrowing portions of 200 West from South Temple to 100 South Street to accommodate Salt Palace Expansion Project) AN ORDINANCE CLOSING AND NARROWING PORTIONS OR STRIPS OF 200 WEST STREET FROM SOUTH TEMPLE TO APPROXIMATELY 100 SOUTH STREET, TO ACCOMMODATE THE SALT PALACE EXPANSION PROJECT. WHEREAS, a request by Salt Lake County Commission, known as City Council Report 89 of 1981, requested the narrowing and vacation of 200 West Street, together with the transfer of air rights in the vicinity of the Salt Palace to accommodate the expansion of the Salt Palace Project; and WHEREAS, a review of the petition indicated that vacation of the street would be contrary to the policy of the City, but in lieu thereof, that the narrowing of the right of way and closure of narrow strips of said right of way would be appropriate, based on the Council's finding that said strips are no longer necessary for the use as a public thoroughfare, avenue, or alley, but should be closed, with the public interest being retained for anticipated transfer to the petitioner, based on certain condi- tions and reservations. THEREFORE, Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the described portions of 200 West Street in the vicinity of the Salt Palace, as said street forms strips on the eastern and western side of said street between South Temple and approximately 100 South Street, in Salt Lake City, Utah, more particularly described below, be, and the same hereby are CLOSED and declared no longer to be needed or available for use as a public street, avenue, alley or pedestrian way. However, the public's interest therein shall be reserved for con- templated transfer to accommodate the expansion of the Salt Palace. Parcel B - strip on the east side of 200 West Street Beginning at a point South 0°03'02" East 74.02 feet from the Northwest corner of Lot 5, Block 77, Plat "A" Salt Lake City Survey. Said Northwest corner being South 0°01107" East 68.98 feet and North 89*58153" East 68.99 feet from the City Monument at the intersection of 200 West (West Temple Street being numbered as 100 West) and South Temple Streets, and running thence South 0*03102" East 638.73 feet; thence South 89`58153" West 21.87 feet; thence North 0*01107" West 398.75 feet; thence North 6°56'58" East 30.21 feet; thence North 0°0'07" West 150.0 feet; thence North 89*58153" East 5.95 feet; thence North 0"0'07" West 30.0 feet; thence North 89°58'53" East 5.95 feet; thence North 0*01107" West 30.0 feet; J thence North 89°58153" East 5.95 feet; to the Point of Beginning. Said closure is EXPRESSLY SUBJECT TO all existing rights of ways and easements of all public utilities of any and every description, now located on, in, under or over the confines of the above-described property, and also SUBJECT TO the rights of entry thereon for the purpose of obtaining, altering, replacing, removing, repairing or rerouting said utilities and all of them. Said closure is ALSO SUBJECT TO any existing rights of ways or easements of private third parties. SECTION 2. This ordinance, after passage, shall be published, but shall not become effective until recorded concur- rently with documents transfering title to the Salt Palace. Said documents to be signed by the Mayor shall include appropriate terms to deal with the maintenance and allocated responsibilities -2- of maintaining that portion of 200 West Street which will remain open and upon which the Salt Palace will reconstruct a portion of its building over the reconstructed 200 West. This ordinance shall be recorded with the County Recorder concurrently with the approved documents to transfer title to all or a portion of said road to Salt Lake County. SECTION 3. This ordinance, after the date of its first publication, shall not become effective until recorded with the Recorder of Salt Lake County, as designated in Section 2 above. If the foregoing conditions are not completed within twelve (12) months from the date of passage, this ordinance shall be null, void, and of no effect and no recording shall be allowed. Section 2 of this ordinance indicates that the ordinance shall not become effective until recorded concurrently with documents transferring title to the Salt Palace. Said documents to be signed by the Mayor shall include appropriate terms to deal with the maintenance and allocated responsibilities of maintaining that portion of 200 West Street which will remain open and upon which the Salt Palace will reconstruct a portion of its building over the reconstructed 200 West. The Salt Lake City Recorder's Office was not informed that these appropriate documents were ever executed, therefore, the ordinance was not recorded with Salt Lake County. In this event, according to Section 3 of the ordinance, if the conditions are not completed within twelve months from the date of passage, this ordinance shall be null, void, and of no effect and no recording shall be allowed. The records in our office will reflect that the conditions were not met and the ordinance is null and void. Attached for your convenience is a copy of the ordinance.
