053 of 2019 - Amending the zoning of property located at 504 South 900 East Street and amending the Central Commun 0 19-1 P 19-16 SALT LAKE CITY ORDINANCE No. 53 of 2019 (Amending the zoning of property located at 504 South 900 East Street and amending the Central Community Master Plan Future Land Use Map) An ordinance amending the zoning map pertaining to property located at 504 South 900 East Street from RMF-35 Medium Density Multi-Family Residential District to R-MU-35 Medium Residential/Mixed Use District and amending the Central Community Master Plan Future Land Use Map pursuant to petition numbers PLNPCM2018-00839 and PLNPCM2018- 00898. WHEREAS, Ian Kaplan of ADDVirtue (on behalf of the property owners, Ivy Partners) submits two land-use applications to the Salt Lake City Planning Division. The first application (PLNPCM2018-00839) requests an amendment to the city's zoning map to rezone a parcel of property located at 504 South 900 East Street from RMF-35 Medium Density Multi-Family Residential District to R-MU-35 Medium Residential/Mixed Use District. The second application (PLNPCM2018-00898) requests an amendment to the Central Community Master Plan Future Land Use Map to change the designation of the same parcel of property from Medium Density Residential to Medium Residential/Mixed Use; and WHEREAS, at its March 13, 2019 meeting, the Salt Lake City Planning Commission held a public hearing and voted in favor of forwarding a positive recommendation to the Salt Lake City Council on both applications; and WHEREAS, after a public hearing on this matter,the city council has determined that adopting this ordinance is in the city's best interests. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Amending the Zoning Map. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that the parcel at 504 South 900 East Street (Tax ID No. 16-05-377- 024-0000), more particularly described on Exhibit"A" attached hereto, is rezoned from RMF-35 Medium Density Multi-Family Residential District to R-MU-35 Medium Residential/Mixed Use District. SECTION 2. Amending the Central Community Master Plan. The Future Land Use Map of the Central Community Master Plan shall be and hereby is amended to change the future land use designation of the parcel identified in Exhibit"A" from Medium Density Residential to Medium Residential/Mixed Use. SECTION 3. Conditions. These proposed amendments are conditioned upon the Applicant entering into a development agreement with Salt Lake City. The development agreement will require: 1) a limitation that the ground floor commercial space will not exceed one thousand (1,000) square feet; 2) removal of the curb cut on the north side of the property and restoration of the area to a landscaped park-strip with trees that meet the City's Urban Forestry tree planting requirements and grow to a minimum height of fifty (50) feet; and 3) charging an additional rental fee for the use of dedicated parking stalls within the project area and seek and identify alternative parking solutions as needed. SECTION 4. Effective Date. This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to publish or record this ordinance until the conditions are satisfied as certified by the Salt Lake City Planning Director or his designee.
