(Temporarily closing a portion of Rio Grande Street between approximately
200 South Street and 235 South Rio Grande Street)
An ordinance temporarily closing a portion of Rio Grande Street as a public right-of-way,
between approximately 200 South Street and 235 South Rio Grande Street, pursuant Utah Code
Section 72-5-105.
WHEREAS, a portion of Rio Grande Street adjacent to the Road Home homeless shelter
has been and is a prime location for dangerous, drug-related criminal activity; and
WHEREAS, Utah Code Section 72-5-105(3) allows a municipality to temporarily close a
class C road in order to mitigate unsafe conditions and "convert the closed portion of the road to
another public use or purpose related to the mitigation of the unsafe condition"; and
WHEREAS, the city has partnered with state and county entities as part of Operation Rio
Grande, the goals of which include mitigating the unsafe conditions in the Rio Grande Street area
and providing a safe place for individuals, including individuals experiencing homelessness, to
receive social services; and
WHEREAS, the city has entered into an agreement dated September 7, 2017 with the
Utah State Division of Facilities Construction and Management(DFCM)to lease the portion of
Rio Grande Street described herein to be temporarily closed in order for state resources to be
utilized toward the end of making that area safe and to provide social services to persons in need
of those services; and
WHEREAS, Utah Code Section 72-5-105(3)(d)(ii) requires that a class C road
temporarily closed pursuant to Section 72-5-105(3)(c)(iii) that is the subject of a lease agreement
between the municipality and another entity must remain closed until the lease is terminated; and
WHEREAS, the lease between the city and DFCM provides that upon the city council's
authorization of a temporary closure of Rio Grande Street, the term of that lease is extended and
shall terminate on January 1, 2020 or thirty (30) days after the Road Home homeless shelter
closes, whichever occurs first; and
WHEREAS, the city council finds after holding a public hearing on this matter and
considering all relevant information presented, that temporarily closing the portion of Rio
Grande Street described herein is necessary to mitigate unsafe conditions in that area; and
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Temporarily Closing City-Owned Right-of-Way. That, in accordance with
Utah Code Section 72-5-105(3), a portion of Rio Grande Street between 200 South Street and
property located at approximately 235 South Rio Grande Street, which is more particularly
described on Exhibit"A" attached hereto, hereby is closed as a public right-of-way for the period
described in Section 2 below and declared not presently necessary or available for use as a public
right-of-way during that period.
SECTION 2. Temporary Closure Period; Reopening. In accordance with the terms of the
aforementioned lease entered into between the city and DFCM, the portion of Rio Grande Street
described herein shall be closed as a public right-of-way from the effective date of this ordinance
until January 1, 2020 or thirty (30) days after closure of the Road Home homeless shelter,
whichever occurs first. Upon the conclusion of the temporary closure period, the mayor shall
direct that the portion of Rio Grande Street described in Exhibit"A" hereto shall be reopened
and all obstructions to vehicular and pedestrian traffic be removed pursuant to the terms of the
lease.

SECTION 3. Effective Date. This Ordinance shall become effective on the date of its
passage.
