056 of 2002 - adopting the tax levy 0 02-1 B 02-9 SALT LAKE CITY ORDINANCE No. 56 2002 (Adopting and ratifying the rate of tax levy upon all real and personal property within Salt Lake City made taxable by law for fiscal year 2002-2003) AN ORDINANCE ADOPTING AND RATIFYING THE RATE OF TAX LEVY UPON ALL REAL AND PERSONAL PROPERTY WITHIN SALT LAKE CITY MADE TAXABLE BY LAW FOR FISCAL YEAR 2002-2003. On June 14, 2001 the Salt Lake City Council approved Ordinance No. 43 of 2001 which adopted the rate of tax levy upon all real and personal property within Salt Lake City made taxable by law for fiscal years 2001-2002 and 2002-2003. That Ordinance was signed by the Mayor on June 18, 2001. On June 18, 2002, the Salt Lake City Council approved Ordinance No. 41 of 2002,which amended Ordinance No. 43 of 2001, by amending and establishing the rate of tax levy upon all real and personal property within Salt Lake City for fiscal year 2002- 2003. That ordinance was signed by the Mayor on June 28, 2002. The rate of tax levy established for fiscal year 2002-2003 in Ordinance No. 41 of 2002 was expressly made subject to a truth in taxation hearing pursuant to Chapter 2, Title 59, of the Utah Code Annotated. On August 7, 2002,pursuant to the requirements of State law, the Salt Lake City Council held a public hearing, which hearing was continued on August 15, 2002. With the conclusion of that public hearing, the Salt Lake City Council has completed all of the statutory requirements for adopting the rate of tax levy for fiscal year 2002-2003. NOW, THEREFORE,be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. PURPOSE. The purpose of this ordinance is to adopt and ratify the meaning and intent of Salt Lake City Ordinance No. 41 of 2002, and to adopt the rate of tax levy upon all real and personal property within Salt Lake City made taxable by law for fiscal year 2002-2003 to defray the necessary and proper expenses of Salt Lake City to maintain the government thereof and for operating and maintaining its libraries and reading rooms and to pay for the costs of State legislative mandates or judicial or administrative orders under Chapter 2, Title 59 of the Utah Code Annotated. SECTION 2. TAX LEVY: 2002-2003. The City Council hereby levies upon all real and personal property within Salt Lake City made taxable by law in the year 2002, for the fiscal year of Salt Lake City beginning July 1, 2002, and ending June 30, 2003, as revenue in the general fund and as revenue in the library fund, a tax of.005267 percent on each dollar of taxable valuation of said property apportioned as follows: (a) .003911 percent shall be credited as revenue in the general fund; (b) .000049 percent shall be credited as revenue in the general fund to be used for repayment of court ordered judgments; (c) .000755 percent shall be credited as revenue in the special library fund; (d) .000006 percent shall be credited as revenue in the special library fund to be used for repayment of court ordered judgments; and (e) .000546 percent shall be credited toward repayment of the Block 37 General Obligation Bonds for the construction of a new City library building and other improvements. The tax levies set forth herein shall be subject to Mayor approval and City Council reconsideration pursuant to § 10-3-1214 of the Utah Code Ann. SECTION 3. CERTIFIED TO AUDITOR. The tax levies hereinabove determined and levied shall be certified by the City Recorder or his designee to the Auditor of Salt Lake County, State of Utah before the 17th day of August 2002 pursuant to the provisions of Chapter 2, Title 59 of the Utah Code Ann. SECTION 4. RESERVE POWER AND RIGHT TO AMEND. The City hereby expressly reserves the power and right to amend any property tax levy made herein as it may deem just, proper and appropriate under the law. SECTION 5. EFFECTIVE DATE. Upon publication, this Ordinance shall be deemed effective as of July 1, 2002. Passed by the City Council of Salt Lake City, Utah, this 15th day of August, 2002.
