AN ORDINANCE VACATING THE WESTERN APIA OF A 15-FOOT WIDE "T"
SHAPED ALLEY LOCATED BETWEEN DEXTER AND 800 WEST STREETS AS IT
RUNS EAST FROM APPROXIMATELY 552 NORTH DEXTER STREET.
WHEREAS, the City Council of Salt Lake City, Utah, finds,
after a public hearing , that the City' s def_easible fee interest
in the portion of the alley described below, which was formally
dedicated within the Thompson 's Subdivision of Block 87, Plat
"C" , is no longer necessary for use as a public alleyway, and
that the vacation of said alley described below will not be
adverse to the general public 's interest.
NOW, THEREFORE, Be it ordained by the City Council of Salt
Lake City, Utah :
SECTION 1 . ALLEY VACATION. That portion of a 15-foot wide
alley located in the Thompson 's Subdivision of Block 87, Plat
"C" , including the western arm of a "T" shaped alley , which arm
runs east at approximately 552 North Dexter Street for 137 feet
between Lots 25 and 26 of said subdivision, which is the subject
of Petition No. 325 of 1982, submitted by William B. Kearns, et
al. , and more particularly described below, be, and the same
hereby is VACATED and declared no longer to be needed or avail-
able for use as a public alley or public way:

Beginning at the Northwest corner of Lot 25, Block 1 ,
Thompson ' s Subdivision, said subdivision being a part
of Block 87, Plat "C" , Salt Lake City Survey; thence
East 137 feet to the Northeast corner of said Lot;
thence North 15 feet to the Southeast corner of Lot 26
of said subdivision; thence West 137 feet to the South-
west corner of said Lot 26; thence South 15 feet, more
or less, to the point of beginning. Contains 0 .4718
acres.
RESERVATIONS. Said vacation is expressly made SUBJECT TO
all existing rights of way and easements of all public utilities
of any and every description now located on, in, under or over
the confines of the above-described property; and also SUBJECT TO
rights of entry thereon for the purpose of obtaining , altering ,
replacing, removing, repairing, or rerouting said utilities and
all of them.
Said vacation is also STTRJECT TO any existina rights of way
or easements of private third parties.
SECTION 2. CONDITIONS SUBSEQUENT. Before this ordinance
may become effective, the petitioners or property owners shall be
responsible to arrange with the Public Utilities Department of
Salt Lake City, for the reconnection of a private water service
line presently located in the alley, to be reconnected to change
the service connection to the 800 West Street right of way. Said
connection and/or removal must be completed according to the
specifications and satisfaction of the Public Utilities Depart-
ment.
SECTION 3. EFFECTIVE DATE. This ordinance, after the date
of its first publication, shall not become effective until

recorded with the Office of the Salt Lake County Recorder.
However, the City Recorder of Salt Lake City is instructed that
she shall not proceed with said recording until such time as the
Public Utilities Department verifies in writing that the condi-
tions subsequent, explained in Section 2 above, has been
completed to its satisfaction and that the reconnection has been
completed and appropriate improvements made for the abandonment
or removal of the line in the alley. If such verification and
recording is not completed within 12 months from the date of
passage thereof, this ordinance shall be null and void, and no
recording thereafter shall be authorized or allowed.
Passed by the City Council of Salt Lake City, Utah,
this 9th day of August , 1983 .
