057 of 2001 - enacting Chapter 21A.43 of the Salt Lake City Code, relating to certain temporary uses from October 0 01-1 0 01-22 SALT LAKE CITY ORDINANCE No. 57 of 2001 (Certain Temporary Uses from October 15, 2001 to and including March 31, 2002) AN ORDINANCE ENACTING CHAPTER 21A.43 OF THE SALT LAKE CITY CODE, RELATING TO CERTAIN TEMPORARY USES FROM OCTOBER 15, 2001 TO AND INCLUDING MARCH 31, 2002. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Chapter 21A.43, SALT LAKE CITY CODE, be, and the same hereby is, enacted to read as follows: CHAPTER 21A.43 CERTAIN TEMPORARY USES FROM OCTOBER 15, 2001 TO AND INCLUDING MARCH 31, 2002 21A.43.010 Extension of Time and Location for Certain Temporary Uses. Notwithstanding the time and zoning district limitations set forth in Section 21A.42.070 of this Code, any temporary uses or structures described in Section 21A.42.070 (C) or(F) of this Code, that are located within the area bounded on the north by North Temple Street, on the east by 200 East Street, on the south by 900 South Street, including the 900 South freeway exit, and on the west by Interstate 15, shall be allowed in G-MU(Gateway Mixed-Use District), CG (General Commercial District), PL (Public Lands District), CN (Neighborhood Commercial District), UI (Urban Institutional District), OS (Open Space District), D1 (Central Business District), D2 (Downtown Support District), D3 (Downtown Warehouse/Residential District), and D4 (Downtown Secondary Central Business District) zoning districts within that area and may be in place from October 15, 2001, to and including March 31, 2002. Except as otherwise provided in this Chapter, the provisions of Chapter 21A.42 of this Code shall apply to such temporary uses or structures. 21A.43.020 Decisions by Mayor or Mayor's Designee. With respect to temporary uses or structures for which an extension of time is granted pursuant to Section 21A.43.010, all decisions required to be made by the zoning administrator under Chapter 21A.42 of this Code shall instead be made by the Mayor of the City or the Mayor's designee, in consultation with an advisory committee comprised as follows: 1. The Special Events Coordinator of the City; 2. The City Attorney or designee. 3. A representative from the Department of Public Services; 4. A representative from the Mayor's Office; 5. A representative from the Transportation Division; 6. A representative from the Police Department; 7. A representative from the Planning Division; 8. A representative from the Building Services and Licensing Division; 9. A representative from the Fire Department; and 10. A representative from the Department of Public Utilities. At the request of the Mayor or the Mayor's designee, the advisory committee shall provide technical advice and recommendations to the Mayor or the Mayor's designee regarding decisions to be made by the Mayor or the Mayor's designee pursuant to this ordinance. Prior to approving any temporary use or structure, the Mayor or the Mayor's designee and the advisory committee shall evaluate structural safety issues, any required fire and building code compliance, and occupancy issues with respect to such temporary use or structure. 2 21A.43.030 Negative Savings Clause If any portion of this Chapter is determined to be illegal, invalid, unconstitutional, or superseded, in whole or in part, this entire Chapter shall be voided and terminated, subject to the following provisions: (a) in the event of a judicial, regulatory, or administrative determination that this Chapter is illegal, invalid, unconstitutional, or superseded, such voiding or termination shall be effective as of the date of a final appealable order: and (b) in the event of any state legislative action that renders this Chapter illegal, invalid, unconstitutional, or superseded, such voiding or termination shall be effective as of the effective date of such legislative action. Because the structures and uses permitted under this Chapter are intended to be temporary, no property interest or vested right is created in any person by this Chapter. If any portion of this Chapter is determined to be illegal, invalid, unconstitutional, or superseded, any person who has erected any temporary structure or made any temporary use for a period of time longer than those set forth in Section 21A.42.070 (C) or(F) of this Code shall cease such use and remove any such structure within fourteen (14) days after receiving notice from the Mayor or the Mayor's designee of such determination. SECTION 2. That this ordinance shall expire at midnight on March 31, 2002, and be of no force and effect thereafter, unless earlier amended,modified or repealed. SECTION 3. That this Ordinance shall take effect on the date of its first publication. 3 Passed by the City Council of Salt Lake City, Utah, this 9th day of August , 2001.
