AN ORDINANCE VACATING A PUBLIC ALLEY LOCATED WITHIN THE
KINNEY AND GOURLAY 'S IMPROVED CITY PLAT SUBDIVISION. SAID ALLEY
IS 20 FEET WIDE AND RUNS WEST FROM VICTORIA WAY, APPROXIMATELY
130 FEET SOUTH OF 10TH NORTH, FOR APPROXIMATELY 140 FEET IN SALT
LAKE CITY , UTAH .
WHEREAS, the City Council of Salt Lake City , Utah finds,
after a public hearing, that the City 's interest-In -the alley
described below, which was platted within the Kinney and
Gourlay 's Improved City Plat Subdivision is no longer necessary
for use as a public way, and that the vacation of said alley
described below will not be adverse to the general public ' s
interest.
NOW, THEREFORE, BE IT ORDAINED by the C.ity Council of Salt
Lake City , Utah :
SECTION 1 . ALLEY VACATION. An alley located in the Kinney
and Gourlay ' s Improved City Plat Subdivision, running west from
Victoria Way for approximately 150 feet and being 130 feet south
of 10th North, which is the subject of Petition No . 400-35 of

1983 submitted by Robert W. Koyen, and more particularly

described below, be, and the same hereby is VACATED and declared
no longer to be needed or available for use as a public alley or

• ,Beginnina at the Southeast corner of Lot 6, Block 69 of
jKinney and Gourlay' s Improved City Plat Subdivision; a
) subdivision in the SW 1/4 , - NE 1/4 , Section 26, T. 1N. ,
R. 1W. , SLB&M; thence Westerly 150 feet to the Southwest
� corner of Lot 8 of said Block 69; thence South 0'08' 33"
' East 20 feet along the east boundary of Lot 7 of Plat
"N" of the Rose Park Subdivision; thence Easterly 150
feet to the Northeast. corner of Lot 5, Block 69 of
Kinney and Gourlay ' s Improved City Plat Subdivision;
thence Northerly 20 feet to the point of beginning.
L' RESERVATIONS : Said vacation is expressly made SUBJECT TO
all existing rights of way and easements of all public utilities
of any and every description now located on, in, under or over
the above-described property and also SUBJECT TO the rights of
entry thereon for the purpose of obtaining, altering , replacing ,
removing, repairing or rerouting said utilities and all of
them. Said vacation is also SUBJECT TO any existing rights of
way or easements of private third parties.
SECTION 2. This ordinance shall take effect thirty ( 30)
days after the date of its first publication.
Passed by the City Council of Salt Lake City , Utah,
this 9th day of August , 1983.
