SPIKES Kathryn Marshall City Recorder 311 City & County Building Salt Lake City, UT 84111 Re: Bill No. 63 of 1982--vacation of a 15' alley from Redwood Road to Prospect Street at approximately 760 South. Dear Kathy: On November 24, 1982, Mrs. Sharp brought to my attention a problem in the legal description contained in Bill No. 63 of 1982. Engineering had informed her they had discovered an error in the technical description which actually describes an alley in the block to the south which is south of 800 South. The Engineering Department has verified that the alley at approximately 760 South just north of 800 South intended to be vacated by the petition lies in Block 4 instead of Block 3 of the Evans Addition to Poplar Grove, Subdivision of Lot 17, Block 24 of the Brighton Farming Plat. From a review of the petition, it consistently refers to the legal description as being located within Block 3; however, the petition specifies that the alley is in the block north of 800 South at approximately 760 South. The map in the petition clearly shows it to be in Block 4 of said subdivision. w 0 0 Consequently, to eliminate the ambiguity of the ordinance and to correct the clerical mistake in Engineering's legal description, the ordinance should be corrected by changing CA Block "3" of said subdivision to Block "4". This number vJ CIn O Xa thryn Marshall November 30, 1982 Page -2- I appears in the first, fourth and fifth paragraphs of Bill No. 63 of 1982. It appears that the error can be most easily resolved by making a technical amendment to the original ordinance and changing the references from Block "3" to Block "4" on the first page of the original ordinance. Then, please publish the corrected ordinance and submit the corrected original bill, or a certified copy, to Barry Lund in the County Recorder's plat office for a corrected recording, with a copy of this letter. Thank you for your help in this matter. If you have any questions please give me a call. Please let me know when you submit the corrected ordinance to Mr. Lund. Sincerely, JUDY'F.
