AN ORDINANCE AMENDING SECTION 32-1 -17 OF THE REVISED
ORDINANCES OF SALT LAKE CITY, UTAH, 1965, AS AMENDED, RELATING TO
LOITERING, BY ADDING SUBSECTION ( 11 ) .
Be it ordained by the City Council of Salt Lake City, Utah :
SECTION 1 . That Section 32-1-17 of the Revised Ordinances
of Salt Lake City, Utah, 1965, as amended , relating to Loitering ,
be, and the same hereby is, amended by adding the following
subsection ( 11 ) .
Sec. 32-1 -1 7. Loitering . It shall be unlawful for any
person to loiter in Salt Lake City. A person is guilty of
loitering when said person:
( 11 ) ( a) is on or in any public area as hereafter defined
and which person remains, wanders idly, or prowls:
( i) in a manner or at a time not usual for law abiding
citizens, or
( ii) under circumstances that warrant a reasonable
alarm or immediate concern for the safety of persons or
property in the vicinity; and
(b) refuses to obey the lawful command of a police officer
to:
( i) move on, or
( ii) provide to said police officer a lawful reason
for remaining on or in said public area as hereafter
defined . The police officer' s command shall be lawfully
given when the alleged loitering by said person creates or
causes to be created :
(aa) a breach of the peace, or
(bb) the actual or attempted obstruction, molesta-
tion or interference of any other person lawfully on or
in any public area as hereafter defined in such a
manner as to cause said other person to reasonably fear
for his or her safety; or
(cc) the obstruction or attempted obstruction of
the free normal flow of vehicular traffic or the normal
passage of pedestrian traffic in said public area; or
(dd) the unreasonable disturbance of any person
acting lawfully on or in any said public area.
(c) For the purposes of subsection ( 11 ) , "public area"
shall mean any place open to the public, including but not
limited to , any common public area of any shopping mall , public-
way, street, highway, alley or park.
SECTION 2. This ordinance shall take effect thirty ( 30 )
days after its first publication.

this 13th day of August , 1985.
