FILMED Q 83-2 MICRO SALT LAKE CITY ORDINANCE No. 7 of 1983 (Alternative Uses of Schools ) AN ORDINANCE AMENDING CHAPTER 6 OF TITLE 51 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, BY ADDING A NEW SECTION 16 RELATING TO CONDITIONAL USES OF SCHOOLS. Be it ordained by the City Council of Salt Lake City , Utah : SECTION 1 . That Chapter 6 of Title 51 of the Revised Ordinances of Salt Lake City, Utah, be, and the same hereby is amended by ADDING a new Section 16 thereto, relating to condi- tional uses of schools, to read as follows : Sec. 51-6-16. Conditional Uses of Schools. 1 . As a special exception to the zoning ordinances, the Board of Adjustment may permit schools which have been tempo- rarily closed or schools with reduced enrollment to be used on a temporary basis for office space for limited public, private, charitable or educational purposes as a conditional use. 2. Approval of any proposed use shall be granted only after the Board has received a favorable recommendation from the Planning Commission regarding such use, and a public hearing has been conducted by the Board of Adjustment regarding the proposed use. Notice of the time and place of hearing shall be given pursuant to the provisions contained in Chapter 3 of this title. No conditional use shall be approved unless the Board of Adjustment finds : (a ) that the proposed use of the particular location is necessary or desirable to provide a service or facility which will contribute to the general well-being of the neighborhood and community. (b) Such use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity . The Board shall have the authority to deny the use if, in its opinion, such use would not be in keeping with the neighborhood, the uses authorized by the zoning ordinance or existing in the neighborhood, or would not be in keeping with the standards set forth above. In the event the Board approves such use, it shall have the power to impose any reasonable conditions deemed necessary to protect the neighborhood. 3. Notwithstanding the above, no conditional use shall be approved unless the following conditions are met: (a) the school board shall remain the owner of the property during the period of time for which the conditional use is granted; ( b) the right to use property for other than public school purposes shall be temporary only. The length of the use shall be subject to the decision of the Board . In no event shall the Board authorize a use for an initial period -2- of time in excess of five ( 5 ) years or a renewal period in excess of five ( 5 ) years; ( c) the Board shall periodically review the use of the school property to determine whether the use should be con- tinued in light of its impact on the neighborhood; (d ) All conditional uses allowed by this ordinance shall be limited to approved public, private, charitable or educational purposes. No provision of this ordinance shall be construed to allow any use for retail , residential , or industrial purposes or any use involving any type of correctional or institutional facility; and (e ) No exterior or interior alterations of the building shall be made which are incompatible with the building 's use as a public school . All modifications must receive prior approval of the Board . 4 . In the event the school board determines that no future public use will be made of the building as a public school , all conditional uses shall cease and the property used only for uses permitted by existing zoning ordinances.
