A Al 46 D 88 - J SALT LAKE CITY ORDINANCE No. 70 of 1988 (Closing an alley running south from 1700 South at 115 West, pursuant to Petition No. 400-609-88 subject to certain conditions AN ORDINANCE CLOSING AN ALLEY RUNNING SOUTH FROM 1700 SOUTH AT 115 WEST, PURSUANT TO PETITION NO. 400-609-88 SUBJECT TO CERTAIN CONDITIONS. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in the public alley described below is not necessary for use by the public as an I alley that closure of said alley will not be adverse to the general public's interest nor divest the City of title to the property without subsequent documents of transfer; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the alley running south from 1700 South at 115 West which is the subject of Petition No. 400-609-88 and which is more particularly described below, be, and the same T hereby is, CLOSED and declared no longer to be needed or ca available for use as a public alley, with the title remaining with the City until subsequent sale for market value: �.i A Said alley is more particularly described as follows: Beginning at a point West 148.5 feet from the North- east Corner of Lot 12, Block 7, 5 Acre Plat "A", Big n OK Field Survey, and running thence South 66 feet more or �Q•,2�'$ less from the South right of way line of X700 South Street; thence West 16. 5 feet; thence North 66 feet more or- less to the South right of way line of 1700 South Street; thence East 16.5 feet to the point of beginning. i SECTION 2. RESERVATIONS AND DISCLAIMERS. The above enclosure is expressly made SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights-of-way or easements of private third parties. SECTION 3. CONDITIONS. Petitioner has agreed to erect a fence at the south end of the vacated alley of a design and construction approved by the City. Petitioner has further agreed to relinquish by recordable instrument any claim to use the private right of way extending south from the closed alley. The Housing Authority of Salt Lake City has been requested to provide an easement for access to the property owners fronting on West Temple from the Housing Authority's driveway between West Temple and Jefferson Circle. Closure of the alley is conditioned upon recordation of the grant of this easement for access. SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication. The City Recorder is instructed not to publish this Ordinance until the conditions set out in Section 3 above have been certified as complete by the Mayor. In the event that such conditions have N not been completed within one year, the Mayor may extend the time 00 for completion by an additional year. If the conditions are not -2- \ i completed as required by this Ordinance, the Recorder is instructed not to post the Ordinance which shall be null, void and of no effect.
