073 of 1983 - Closing a portion of 1600 South Street from approximately 400 West for approximately 150 feet .,..-�IS ORDI ANCE WAS SUPERSEDED BY BILL rZ98 -`-AND WAS NOT RECORDED** P 83-480 SALT LAKE CITY ORDINANCE No. 73 of 1983 (Closing a certain portion of 1600 South Street between 300 and 400 West in Salt Lake City, Utah) AN ORDINANCE CLOSING A PORTION OF 1600 SOUTH STREET FROM APPROXIMATELY 400 WEST, PROCEEDING EASTWARD ALONG THE NORTH AND SOUTH BOUNDARIES OF SAID STREET FOR APPROXIMATELY 150 FEET IN SALT LAKE CITY, UTAH. WHEREAS, the City has received a request by West Properties, Inc. , known as Petition No. 321 of 1982, requesting the closure of a certain portion of 1600 South Street located between 300 and 400 West in Salt Lake City; and WHEREAS, the City finds, after public hearing , that the subject portion of 1600 South Street proposed for closure is not and will not be needed for use by the public as a vehicular thoroughfare; that with the reservation of certain easements and conditions subsequent, the closure of said street will not be adverse to general public 's interest nor will it relinquish and terminate the City 's interest in the underlying property, without separate documents of transfer; and WHEREAS, it is the City 's intention upon closure of said street to transfer to the petitioner, under separate document, the underlying property interest currently held by the City subject to certain terms and conditions, reservation of appro- priate easements and conditions subsequent. NOW, THEREFORE, Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1 . A certain portion of 1600 South Street located between 300 and 400 West which is the subject of Petition No. 321 of 1982 , which is more particularly described below, be, and the same is hereby CLOSED and declared no longer to be needed or available for use as a public street, but title to the City' s interest therein shall be reserved and retained by Salt Lake City Corporation: ,,-,Beginning at a point 120 feet South from the north- ,,,py,3) west corner of Lot 20, Block 9 , 5 Acre Plat "A" , Big tj �7 Field Survey; thence East along the north line of 1600 South Street, 150 feet; thence South 46. 10± feet to the south line of said street; thence West along said line 150 feet; thence North 46. 10± feet to the point of beginning . (Contains . 15875 acres) RESERVATIONS. Said closure is expressly made SUBJECT TO all existing rights of way and easements of all public utilities of any and every description now located on, in, under or over the confines of the above-described property; and ALSO SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering , repairing, removing or rerouting said utilities and all of them. Said closure is SUBJECT TO any existing rights of way or easements of private third parties. SECTION 2. This ordinance, after passage, shall be published but shall not become effective until the following conditions subsequent have been satisfied: -2- ( 1 ) The petitioner shall pay the City the fair-market value of the street to be vacated. ( 2 ) The petitioner shall pay the appraisal costs incurred to determine the fair-market value of the petitioned property. ( 3 ) The petitioner shall prepare engineering drawings and specifications in accordance with the City's requirement describing the improvements necessary to shorten the street and that said improvements be installed at the petitioner ' s expense. The street improvements shall include the installation of curb and gutter on the remaining portion of 1600 South which abuts the petitioner's property. ( 4 ) The petitioner shall install a cul-de-sac at the west end of 1600 South, in accordance with the Engineer ' s specifications. ( 5 ) The petitioner install three 18-inch by 18-inch red reflectorized diamond-shaped warning panels three feet west of the cul-de-sac curb. SECTION 3. EFFECTIVE DATE. This ordinance, after the date of its first publication, shall not become effective until recorded with the recorder of Salt Lake County. However, the Salt Lake City Recorder is instructed not to record this ordinance until the Mayor verifies that the conditions subsequent have been satisfied or provided for by executed agreement. Upon verification of satisfaction, the Mayor may transfer the property to the petitioner and instruct the recorder to record the -3- ordinance concurrently with the transfer documents. However, if the foregoing conditions are not completed within twelve months from the date of passage, this ordinance shall be null, void and of no effect and no recording thereafter shall be allowed.
