between 350-400 East)
AN ORDINANCE CLOSING A PORTION OF OBLAD STREET, (APPROXI-
MATELY 530 SOUTH) IN BLOCK 22 OF PLAT "B" OF SALT LAKE CITY
SURVEY BETWEEN 350 - 400 EAST.
WHEREAS, there is currently plotted as part of the public
streets of Salt Lake City a street, more particularly described
as Oblad Street, (530 South), running west from 400 East to
Stanton Avenue; and
t411E1:EAS, the closure of Oblad from 350-400 East was
initiated by the City to facilitate its urban block redesign
pr.oyram for said Block to reduce traffic, provide additional open
space and parking for the existing residential portions of said
Block; and
WHEREAS, the closure of Oblad Street from approximately 350-
40E East is acceptable to the landowners abutting the portion of
Oblad to be closed, who desire to amass their now vacant land and
develop it as part of a large residential project, hereinafter
"Project" and said landowners control parcels which will be
exchanged for Oblad to provide space for the needed turnarounds
and parking; and
WHEREAS, the City finds that if the proposed Project is
developed, that said street would no longer be needed for use of
the public us vchicul.ar thor.ou,+hfares; and in light of the
proposed redesign program and potential project that the closure
of said road would not be adverse to the general public's
interest, nor would the closure have any,cffect independently to
relinquish or terminate the City's interest in the underlying g

WHEREAS it is the City's intention, y upon closure of said �
streets to retain the City's interest in said land until it is

appropriately exchanged and transferred to the owners and

developers of the Project under separate document, upon
aplo opriate terms ( including payment of the fair market value)

TH KRHFORE, be it ordained by the City Council of Salt Lake
City, Utah:
SECTION 1. Closure of Oblad Street. That the portion of
Oblad Avenue, as it lies at approximately 530 South between 350-
400 East, more particularly described below, be, and the same
hereby is, CLOSED and declared no longer to be available for use
as a street, avenue, alley or pedestrian way.
Commencing at a point 233.5 feet south of the
northeast corner of Block 22, Plat B, S.L.C.
Survey; thence Vest 238.75 feet; thence south 22
feet; thence cast 238.75 feet; thence north 22
feet to point of beginning.
SECTION 2. Reservations. The Closure of the street
described in Section 1 is made expressly SUBJECT TO the following
reservations:
1. Said closure is expressly made SUBJECT TO all existing
rights of ways and easements of all public utilities of any and
every description now located on, in, under or over the confines
of the ahove-described property, if any; and also SUBJECT TO the
rights of entry thereon for the purposes of maintaining,
altering, repairing, replacing, removing, or rerouting said
utilities and all of them.
2. Said closure is also expressly SUBJECT TO any existing
rights of ways or easements of private third parties.
3. Said closure expressly RESERVES the public's interests
in said streets and underlying property. Said legislative act of
closing said street is not intended to be an abandonment of the
public's interest in said road or street, but is merely a closure
of the area for use as public thoroughfare. Said Property shall W
be retained as public property that may be available for

SECTION 3. Consideration - Conditions Subsequent. Certain
,nditions and representations have provided the consideration
for this legislative act fostering the Project. Any documen-
tation transferring the public's interest in the land described
in Section 1 above must reflect the following conditions:
1. That said Project's developers and any other abutting
property owner(s) bear all expense of abandoning and/or
relocating any existing utilities or drainage facil.iti.es
presently located upon the propc,r.ty. n::veloper.-s of the Project

associated with the work before any new building permits may be
issued.
2. That subsequent- documentation transferring title of the
Property described above shall require economic consideration at

Of its first puhlication, shall not become effective until
recorded with the Recorder of Salt Lake County. However, the
City Recorder of Salt Lake City is here-by instructed not to
record until the Mayor provides assurance that the Agreement and
transfer documents have been executed and that all bonds or other
conditions guaranteeing contract perforc,=_nce have been provided
by the Developer. Upon approval by the Mayor of the documents
necessary to complete the transfer, this closure ordinance may be
recorded concurrently with said documents.
