AN ORDINANCE CLOSING A PORTION OF 700 SOUTH STREET BETWEEN
800 WEST AND THE I-15 RIGHT OF WAY AND AN ADJACENT ALLEY RUNNING
NORTH FROM 700 SOUTH STREET BETWEEN 800 WEST AND THE I-15 RIGHT
OF WAY IN SALT LAKE CITY, UTAH.
RECITALS
A. The City has received a request by the LDS Church known
as Petition No. 400-61 of 1983 , requesting the closure of a
certain portion of 700 South Street located between 800 West and
the I-15 right of way , and an abutting alley running north from
700 South Street for approximately 172 feet, located between 800
West and I-15 right of way.
B . The City finds, after public hearing , that the subject
properties are not and will not be needed for use by the public
as vehicular thoroughfares and that closure, rather than vaca-
tion, of said public road and alley is the appropriate procedure
in this instance, with the reservation of certain easements and

conditions subsequent . The closure of said street and alley will
not be adverse to the general public 's interest, nor will it (P

relinquish and terminate the City interest in the underlying

property without separate documents of transfer.

C. It is the City ' s intention upon closure of said street
to transfer to the petitioner under separate document the
underlying property interest currently held by the City subject
to certain terms and conditions, reservations and appropriate
easements and conditions subsequent.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Salt
Lake City , Utah:
SECTION 1 . A certain portion of 700 South Street located
between 800 West and the I-15 right of way, and a portion of an
alley also located between 800 West at I-15 which runs north from
700 South for approximately 172 feet, which are the subject of
Petition No. 400-61 of 1983 , which are more particularly
described below, be, and the same hereby are CLOSED and declared
no longer to be needed or available for use as a public street
and a public alley; and the title to the City' s interest therein
shall be reserved and retained by Salt Lake City Corporation:

altering, repairing, removing or rerouting said utilities includ-

SECTION 2. This ordinance, after passage, shall be
published but shall not become effective until the following
conditions subsequent have been satisfied :
1 . The petitioner shall pay the City fair-market value of
the street and alley to be closed.
2 . The petitioner shall prepare street improvement plans
for 800 West, including a standard driveway approach apron to the
petitioner's property.
3 . All fees shall be paid by the petitioner to secure the a

necessary permits in order to perform work in the public way. Cn
4. The petitioner meet the requirements of any public CAD
utilities with facilities in, over or under the permitted right <r

of way for such construction.

5. Petitioner shall provide perpetual access to the Utah
Department of Transportation I-15 easement.
SECTION 3. This ordinance, after the date of its first
publication, shall not become effective until recorded with the
recorder of Salt Lake County; however, the Salt Lake City
Recorder is instructed not to record this ordinance until the ,
Mayor verifies that the conditions subsequent have been satisfied
or provided for by executed agreement. Upon verification of
satisfaction, the Mayor may transfer the property to the peti-
tioner and instruct the recorder to record the ordinance
concurrently with the transfer documents. However, if the
foregoing conditions are not completed within 12 months of the
date of passage, this ordinance shall be null , void and of no
effect and no recording thereafter shall be allowed.
