AN ORDINANCE AMENDING Title 24 of the Revised Ordinances of
Salt Lake City, Utah, 1965, as amended, relating to Municipal
Government; AMENDING Title 25 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, by REPEALING Chapter 3 and
Chapter 15 and REPEALING Sections 25-1-1 through 25-1-6, Sections

Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Title 24 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, relating to Municipal
Government, be, and the same hereby is, AMENDED as follows:

Chapter 1
GOVERNMENT ORGANIZATION
Sections:
24-1-1. Purpose.
24-1-2. Government Organization.
Sec. 24-1-1. Purpose. It is the intent and purpose of this
title to establish and clarify the organization and operation of
City departments and to provide for an orderly means of
conducting the operations of City government. Pursuant to
Chapter 3, Title 10 of the Utah Code, Chapters 1, 2, 3 and 4 of
these Revised Ordinances provide for the division of
administrative services into departments, divisions and bureaus
and define the duties and functions of each. These chapters
constitute the Administrative Code of the City.
Sec. 24-1-2. Government Organization. The municipal
government of Salt Lake City is divided into separate,
independent and equal branches of government: (a) the Executive
Branch, which consists of the elected Mayor of Salt Lake City,
and the administrative departments of the City, together with
department heads, officers and employees; and (b) the Legislative
Branch, which consists of a Municipal Council and their staff.

The Mayor shall be elected at large by the voters of the
municipality and shall exercise the executive powers of the
government. The Council shall consist of 7 members, who are
residents of and elected from their respective council
districts.
Chapter 2
OFFICE OF THE MAYOR

Sec. 24-2-1. Mayor; Functions and Duties. The Mayor shall
be the chief executive officer of the City and its official head
for all ceremonial purposes. The Mayor shall be responsible for
the proper administration of all affairs of the City with which
the office is charged. The Mayor's powers and duties include but
are not limited to the following:
(1) Supervising the administration and enforcement of all
laws and ordinances of the City;
(2) Administering and exercising control of all departments
of the City;
(3) Supervising the administrative functions of other
departments and agencies which are related to or affect City
operations, to the extent requested or delegated by the officers
or bodies having primary responsibility for the operation of such
departments or agencies;
(4) Authorizing the issuance of such administrative rules
and regulations and outlining general administrative procedures
applicable to areas of operation and departments confided to the

mayor's supervision, which are not in conflict with the laws of
the State or of City ordinances;
(5) Preparing an annual budget and submitting the same to
the City Council;
(6) Keeping the City Council informed as to the financial
condition of the City on a quarterly basis or such longer time as
the Council shall request;
(7) Recommending to the Council for adoption such measures
as may be deemed necessary or proper for the efficient and proper
operation of the City;
(8) Attending City Council meetings;
(9) Preparing and submitting to the Council: (a) A state
of the City report during January of each year, and (b) an annual
report of the City's financial affairs, within 180 days following
the close of the City's fiscal year;
(10) Subject to the requirements of statutes and ordinances
now or hereafter lawfully enacted, supervising the purchase of
materials or services and otherwise authorizing expenditures of
funds on behalf of the City;
(11) Making all appointments to all City committees,
boards, commissions and other advisory bodies in the City, after
having received the advice and consent of the Council on each
separate prospective appointment, as provided or required in
State law, and removing the same.
(12) Hiring and making all appointments regarding all
executive department employees, officers and agents (subject to
the advice and consent of the Council where required by State
law), and disciplining or terminating the same.
(13) Performing such other duties as may be prescribed or
permitted by law, including: issuing proclamations; vetoing
ordinances, tax levies and appropriations, subject to Council
veto override as provided by State law; and establishing job
descriptions, job functions, job classifications or
reclassifications and compensation therefor, within the budgeted

appropriations and consistent with State law.
Sec. 24-2-2. Office of the Mayor; Chief Administrative
Officer; Delegation and Assignment of Duties. (1) Chief
Administrative Officer. The Mayor may appoint a Chief
Administrative Officer to exercise such powers of administration
and perfonn such duties as the Mayor shall prescribe which are
not inconsistent with law. Said Officer may be removed at the
sole discretion of the Mayor and may also be known as and
designated by the title of "City Administrator." The Chief
Administrative officer shall be appointed on the basis of
professional competence.
(2) Office of the Mayor. Subject to the limitations and
requirements of applicable budget appropriations, the Mayor shall
have assistants and officers who shall perform such functions and
duties as may be assigned to them by the Mayor. In order to
provide proper staff and management services to the City and its
departments, the Mayor is authorized to establish within the
office of the Mayor such divisions or sections as may seem
necessary or proper for the purposes aforesaid.
(3) Delegation and assignment of Duties. From time to time
the Mayor may: (a) abolish, change or reorganize or to transfer
functions, duties and services, (b) assign or reassign personnel
between any section or division of the Office of the Mayor, and
(c) transfer functions, duties, services and assign or reassign
personnel from, to or between any section or division of the
Mayor's Office and between and among any of such departments and
sections or divisions of the administrative organization of the
City; provided, however, that no such mayoral action may be
inconsistent with chapter 3 of this title.
Sec. 24-2-3. Relationship of City Council to Mayor and
Departments. (1) The Mayor, or departments designated by the
Mayor, shall provide such information concerning City finances,
operations and procedures, as requested by the Council and
necessary for the Council to fulfill its statutory duties, which

are not privileged, private or confidential.
(2) No Councilmember shall interfere in any way with the
performance of officers, employees or agents working for the
administrative branch of government; give orders to any
subordinate of the Mayor; or request any person to be appointed
to or removed from office, except in writing to the Mayor.
Sec. 24-2-4. Executive Committees and Miscellaneous
Boards. (1) The Mayor may administratively establish, from City
personnel and private individuals, committees to assist and
provide counsel.
(2) Various boards, committees and other organizations of
or from the community, not otherwise provided for in these
administrative ordinances, shall report to, coordinate with or
have City liaison with the executive branch of city government
through the Mayor or the Mayor's designee. These organizations
include the Sister City Committee, Salt Lake Library Board, Salt
Lake City-County Board of Health, Salt Lake Council of
Governments (C.O.G.) and the Wasatch Regional Front Council.
Sec. 24-2-5. Vacancy in Office of Mayor; Absence or
Incapacity; Appointment of Successor. (1) If the duly elected
Mayor shall die, resign, terminate legal domicile within the
corporate limits of Salt Lake as determined by a court of
competent jurisdiction or be judicially removed from office, the
Office of Mayor shall become vacant. The Council shall within 30
days after such vacancy appoint a resident of Salt Lake City, who
is otherwise qualified to be elected Mayor to fill said
vacancy. The person so appointed shall serve as Mayor until the
next municipal election and until a successor shall be duly
qualified, elected and sworn into office.
(2) Council Chairperson, Acting Mayor. Until a successor
Mayor is appointed by the Council as above provided, the
chairperson of the Council shall be the acting Mayor.
(3) Absence or Incapacity of Mayor. The absence of the
Mayor from the City or the temporary physical or mental

incapacity of the Mayor shall not be deemed to cause a vacancy in
the Office of the Mayor. However, if the Mayor shall judicially
be determined to be totally and permanently incapacitated (either
physically or mentally) to an extent that the said elected or
appointed Mayor cannot perform the mayoral functions for the
remainder of the unexpired term, the Office of the Mayor shall be
deemed vacant and shall be filled, as above provided in
subsection 1.

ADMINISTRATIVE ORGANIZATION

Sec. 24-3-1. Administrative Organization. Subject to the
limitations and requirements of applicable budget and
appropriations, the City's administrative organization shall
consist of operating departments, offices and divisions or
bureaus. Each department shall be identified and have the
duties, functions and responsibilities as hereafter generally
designated and as assigned by the Mayor. Each shall be organized
into such divisions as may be determined by the Mayor to be
appropriate to carry out its functions.
Sec. 24-3-2. Department of Budget and Management Planning.
(1) Functions. Budget and Management Planning shall have

charge of and be responsible for coordinating the preparation,
evaluation and monitoring of the City's operating and capital
budgets, subject to the final review and adoption by the City
Council and Mayor.
(2) Budget Officer. The Director of Budget and Management
Planning shall be the Budget Officer for the Mayor, as provided
by State law.
Sec. 24-3-3 Office of City Attorney.
(1) Functions. The City Attorney shall be the chief legal
officer of the City and shall be responsible to the Mayor and
City Council for the proper administration of the legal affairs
of the Executive and Legislative branches of City government.
The executive and legislative branches of government shall
enjoy equal and independent access to the services of the Office
of the City Attorney with reference to their respective functions
and duties. It shall be the responsibility of the City Attorney
to administer the Office of the City Attorney in a manner which
will enable the Mayor and City Council to fulfill their
respective duties in a timely fashion.
The foregoing notwithstanding, the City Attorney shall not
in any instance, either personally, or by his deputies, act as
both prosecutor and advocate before (and at the same time advisor
to) any board, commission, agency, officer, official, or body of
the City. In cases where such a conflict shall arise, special
counsel may be employed who shall not be subject to the control
or direction of the City Attorney in such matter, and who shall
provide the legal service to or before such board, commission,
agency, officer, official, or body.
(2) Separate Executive or Legislative Counsel. Nothing
herein shall be construed to prohibit either the City Council or
Mayor from retaining separate counsel from appropriated funds, as
either may from time to time deem appropriate.
Sec. 24-3-4. Department of Finance and Administrative
Services.

(1) Functions. The Department of Finance and
Administrative Services shall have charge of and be responsible
for central support and financial services required for City
operations. Included, in these services shall be purchasing,
fleet management, data processing, property acquisition and
disposition, cash management and investment, accounting, payroll,
financial reporting, revenue collections and disbursements,
licensing, recording of all public documents of or for the City,
and administrative support of the circuit court and elections.
(2) City Auditor. The Director of the Department or the
Mayor's designee within this department shall be the City
Auditor, within the meaning of the Uniform Fiscal Procedures Act
of the State.
(3) City Treasurer. The functions of City Treasurer shall
be assigned to the department under the administrative direction
of the Director. The City Treasurer shall: (a) supervise the
collection of all taxes, assessments, fines, forfeitures, service
charges, intergovernmental revenue, licenses, fees, and other
revenues of the City, as provided for by applicable laws and
ordinances; (b) be responsible for the disposition of City
revenues; (c) provide for the investment of idle cash; (d) make
all disbursements of funds of the City, subject to budget
appropriations; (e) keep an accurate and detailed accounting of
all transactions, receipts, disbursements and other matters
within the Treasurer's charge as provided in the Uniform Fiscal
Procedures Act and as the City may by ordinance or resolution
direct; (f) maintain legally required balances in sinking fund
accounts and special improvement district guarantee fund
accounts; (g) record the bond of the City Recorder as required by
Section 10-3-825 Utah Code Ann. or any successor statutes; and
(h) execute all checks of the City consistent with State law.
(4) City Recorder. The function of the City Recorder shall
be assigned to the department, under the administrative direction
of the director; however, the said Recorder shall be responsible

to the City Council which shall have equal and independent access
for services with respect to legislative functions.
The City Recorder shall keep the corporate seal and all
official papers and records of the City, keep a record of the
proceedings of the City as required by law, seal and attest all
legal documents of the City and do those other matters prescribed
by law.
(5) Court Clerks and Traffic Violations Bureau. There
shall be appointed a Court Executive or Court Clerk for Circuit
Court, together with a general supervisor and support staff for
operation of the civil, criminal, and City Traffic Violations
Bureau. The deputy or assistant clerks of the court shall be
deputy city recorders; however, the authority of appointment of
the Court Executive or Court Clerk and the direction and
definition of the court clerk's office activities, which support
and relate directly to the circuit court's operation, shall be in
the presiding judge, consistent with the provisions of section
78-4-25(e) Utah Code Ann., 1953, as amended, or any successor
provision. The City shall appoint the general supervisor and
staff, after consulting with the Presiding Judge or his/her
designee.
(6) Office of Personnel Management. There shall be
appointed a Personnel Manager who shall have charge of and be
responsible for the administration of all personnel functions of
the City. The personnel office shall provide staff and clerical
support to aid the civil service commission in fulfilling its
duties under State law and chapter 10 of title 24 of these
Revised Ordinances or successor sections. The office shall also
provide staff and clerical support to aid the career Service
Personnel Advisory Board, which is presently comprised of the
same members as the Civil Service Commission, in fulfilling its
duties under chapter 11A of title 25 of these Revised Ordinances
or successor sections.
Sec. 24-3-5. Department of Airports and Airport

Authority.
(1) Functions. The department shall have charge of and be
responsible for the planning, design, construction, operation,
maintenance, administration and management of all airport
properties and attendant facilities under jurisdiction of Salt
Lake City, including any required satellite operating or support
facilities.
(2) Airport Authority Board. The Airport Authority created
under and functioning pursuant to the provisions of chapter 20 of
title 2 of these Revised ordinances shall provide citizen
assistance and direction to the Director of Airports and shall
coordinate, report and receive direction on administrative and
executive functions from the Mayor. It shall coordinate and
report legislative matters through the Mayor to the City Council.
Sec. 24-3-6. Department of Public Works.
(1) The Department of Public Works shall have charge of and
be responsible for: (a) the supervision of the design and
construction of the public works of the City; (b) the operation
and maintenance of streets, parkways, sidewalks, drainageways,
traffic control devices, street lighting and similar public-ways
and facilities; (c) other property or works and the supervision
and coordination and all construction work or alterations carried
out within the public-ways of the City; (d) for the collection
and disposal of all solid waste generated within the City as
provided for in City ordinances; and (e) maintenance and repair
of all ditches, flumes, culverts and drains or irrigation systems
operated within City streets or rights-of-way.
(2) City Engineer. The position of City Engineer shall be
assigned to the Department of Public Works, under the
administrative direction of the Director of Public Works. The
City Engineer shall be a registered professional engineer of the
State of Utah and shall be responsible for the review,
supervision and acceptance of all engineering and architectural
design, and construction work required by or for the City, except

as assigned in these ordinances to other departments or offices
of the City; the coordination and supervision of all construction
work done within the public rights-of-way of the City; and the
records of public improvements as prescribed by State statute.
Said duties may be delegated as deemed prudent and appropriate;
such delegation may include the Utilities Department (for
recording and maintaining engineering records relating to the
water and sewer systems and its engineering functions) and the
Department of Airports.
Sec. 24-3-7. Department of Public Utilities.
(1) Functions. The Department of Public Utilities shall
have charge of and be responsible for: (a) the acquisition,
transportation, storage, treatment, and distribution of all
irrigation, raw and potable water for the City and its designated
service areas, including but not limited to: (i) all farms and
watershed lands, so far as the same affect the water supply of
the City; (ii) all water sources from which the domestic supply
is or may be taken; (iii) all reservoirs, conduits, tanks, water
mains, City fire hydrants located within Salt Lake City and
appurtenant equipment and properties; (iv) irrigation gates,
dams, flumes, ditches and reservoirs necessary for the proper
control and distribution of irrigation water within the corporate
City limits or for which the City is acting as distributing
agent; and (b) keeping records of the location of all principal
gates, dams, flumes, ditches, canals and reservoirs and water
rights owned by the City, which records shall show the nature of
construction, the length and capacity of the principal canals and
ditches, and such other information as may be necessary to enable
a proper understanding of the City's rights from an examination
thereof and (c) the collection, treatment, and disposal of all
wastewater (sewage) generated within the City or its designated
service areas.
(2) Water Boards, Miscellaneous. The Director of Public
Utilities shall represent the City, if consistent with law, on

the various water or sewer boards, commissions, and similar
administering bodies on which the City is entitled to sit by
virtue of State law, contractual agreement or by-laws of said
bodies.
Sec. 24-3-8. Department of Development Services.
(1) Functions. The department have charge of and be
responsible for: (a) the development of the City's master land
use and public facility plan; and (b) the development,
administration and enforcement of all attendant laws, codes,
ordinances and relative regulations (including but not limited to
future land use plans, zoning ordinances, subdivision
regulations, and building and housing codes), intended to serve
the implementation of said plans.
Sec. 24-3-9. Parks Department.
(1) Functions. The Parks Department shall have charge of
and be responsible for: (a) the general supervision,
maintenance, upkeep and control of the City's parks, playgrounds,
athletic fields, golf courses, pools, and other recreational
areas and facilities; (b) the City's Cemetery; (c) recreational
activities, cultural and arts programs of the City; and (d)
maintenance and upkeep of shade trees and other plantings,
together with the abatement of weeds and other noxious vegetation
in the City's public-ways or on other public property.
Sec. 24-3-10. Fire Department.
(1) Functions. The Fire Department shall be responsible
throughout the City for the protection of life and property from
damage or loss due to fire, through measures including, but not
limited to: (a) the development and administration of public
education and fire prevention programs; (b) fire safety; (c) fire
and safety inspections of buildings and proposed building plans;
(d) fire rescue and emergency services; (e) fire combat; and (f)
post investigation of fires for possible arson.
(2) Duties. The Chief of the Fire Department shall be the
appointing power and have the command over all the officers,

members and employees of the department. It shall be the duty of
the Chief of the Fire Department, subject to the approval of the
Mayor, to make and adopt such rules and regulations for the
administration and operation of the department as in his/her
judgment shall be necessary for the good of the service.
Sec. 24-3-11 Police Department.
(1) Functions. The Police Department by and through its
sworn officers, shall be responsible for preserving the public
peace, preventing crime, detecting and arrest criminal offenders,
protecting the rights of persons and property, regulating and
controlling motorized and pedestrian traffic, training sworn
personnel, and providing and maintaining police records and
communications systems.
(2) Duties. The Chief of the Police Department shall be
the appointing power and have command over all the officers,
members and employees in the department. It shall be the duty of
the Chief, subject to the approval of the Mayor, to make and
adopt such rules and regulations for the operation and
administration of the department, as in the Chief's judgment,
shall be necessary for the good of the service.
Chapter 4
CITY COUNCIL

Sec. 24-4-1. Council Terms and Districts. (1) District
division and terms. Salt Lake shall be divided into seven
council districts of substantially equal population. One non-
partisan candidate shall be from each council district. Council
members elected shall serve four year terms; however, council

members inaugurated January 7, 1980 from districts 1, 3, 5 and 7
shall initially serve a term of 2 years. After the intial terms
commencing January 7, 1980 have been completed, all subsequent
terms shall be for four years.
(2) District Boundaries. The legislative districts of the
City are as provided on the map duly approved by the Council.
Said districts shall be enlarged by subsequent contiguous City
annexations and shall be reapportioned following each federal
decennial census to maintain substantially equal populations.
The Council shall by resolution or ordinance adopt said district
boundary modifications and may, also, by resolution or ordinance
adopt maps and/or meets and bounds descriptions of the
districts. A current copy of all such maps, resolution and
ordinances shall be on file with the City Recorder and available
for public inspection.
Sec. 24-4-2. Council Powers. The Council shall exercise
the legislative powers of City government, including the adoption
of ordinances and resolutions; setting appropriate tax levies;
adopting the City budget; establishing sewer and water rates and
setting other general tax and service rates. The Council shall
supervise, appoint, and direct its own staff and establish job
descriptions, job functions, job classifications or
reclassifications and compensation therefor, within the budgeted
appropriations and consistent with State law. It may also review
and monitor the municipal administration, conduct public hearings
and perform all other duties and responsibilities authorized or
required by State law. The council shall consider and give,
where appropriate, its advice and consent to the Mayor on all
proposed appointments to City boards, commissions, committees or
other bodies established to provide advice or assistance to the
operation of City government, except as may otherwise be
specified by law.
Sec. 24-4-3. Meetings of Council. (1) Regular Meetings.
The Council is a part-time legislative body, but shall meet not

less than twice monthly.
(2) Special Meetings. Special meetings may be called by
order of the chairperson of the Council, by a majority of the
Council members or by the Mayor. The order signed by the party
calling the meeting shall be filed with the City Recorder and
entered in the minutes of the Council. Notice of said special
meeting shall be given to the Mayor and all council members who
have not joined in said order, not less than 48 hours before said
special meeting. Said notice shall be served personally or a
copy thereof left at the said Council member's or Mayor's place
of abode, either by leaving it with a person of suitable age and
discretion or taping a copy thereof to the front door by the City
Recorder or his/her designee.
(3) Emergency Meetings. Emergency meetings of the Council
may be called by order of the Mayor or by a majority vote of the
council, to consider unforeseen matters of an emergency or urgent
nature. Such meetings may be held without any specific advance
notice, but shall be had at a time so as to give the Mayor and
all council members the most opportunity to be present,
considering the extingencies requiring the emergency meeting.
However, notice of said meeting shall be attempted by the best
means practical under the circumstances to the Mayor and each
council member, not joining in the said order.
(4) Open Meetings. All official meetings of the Council
shall be open to the public as required by the Utah Open and
Public Meetings Act or its successor; provided, however, that
executive sessions may be closed by a 2/3 majority vote of the
council members present at an open meeting, for discussions of
appropriate matters as provided in the Utah Open and Public
Meetings Act or its successor. No final decisions shall be made
in closed meetings.
Sec. 24-4-4. Meeting Schedules, Agendas and Minutes. (1)
The City Recorder will publish in a newspaper of general
circulation in Salt Lake City the annual meeting schedule of the

City Council, stating the date, time and place of such regular
meetings. Said publication shall be made at least once each
calendar year before May 15th and within 30 calendar days
following a change thereof.
(2) In addition to the foregoing notice, the Council shall
cause an agenda to be prepared for each regular or special
meeting of the Council, which agenda shall be reasonably specific
and sufficient to identify the matters to be considered by the
Council; it shall also state the date, time and place of the
meeting. A copy of said agenda shall be posted in the office of
the City Recorder and a copy given to a local media correspondent
or posted in the press room located in the City and County
Building not less than 24 hours before said special or regular
meeting. Notices of emergency meetings shall be given in the
best practicable manner, under the circumstances, to the public
and a member of the local news media.
(3) Minutes shall be kept of all open or closed meetings
and shall contain a record of those matters required by the Utah
Open and Public Meetings Act or its successor. The Minutes shall
be public records, filed with the City Recorder and required to
be kept by State law shall be recorded and available for public
inspection, within a reasonable time after the conclusion of said
meeting(s).
Sec. 24-4-5. Council Organization and Rules. The Council
shall elect a chairperson from its number and shall determine by
resolution its order, rules, procedure and organization from time
to time as it deems prudent and appropriate.
Sec. 24-4-6. Council Vacancies. In the event of a vacancy
in the Council, it shall within 30 days of the occurrence and
declaration of such vacancy, by majority vote of the remaining
council members, appoint a qualified elector of the City to fill
the unexpired term. Said appointee shall serve with all of the
rights and powers of a duly elected council member, until the
next election and the date a successor is duly elected, qualified

and sworn into office. A vacancy shall occur if a council member
shall die, resign, terminate legal domicile within the corporate
limits of Salt Lake and the appropriate council district
boundaries, or be judicially removed from office.
SECTION 2. That Title 25 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, be, and the same hereby is,
amended by REPEALING Chapter 3 and Chapter 15 thereof, and
REPEALING Sections 25-1-1 through 25-1-6, Sections 25-2-1 through
25-2-6, Section 25-11A-4, Sections 25-12-1 through 25-12-9,
Sections 25-13-1 through 25-13-7, Sections 25-14-1 through 25-14-
25, Sections 25-15-1 through 25-15-23, Sections 25-16-1 through
25-16-9, Sections 25-17-1 through 25-17-16, Sections 25-18-1
through 25-18-7 and Sections 25-22-1 and 25-22-2, and all of
Title 34.
SECTION 3. That Title 33 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, be, and the same hereby is,
amended by REPEALING Sections 33-1-1 and 33-1-2.
SECTION 4. That Title 49 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, be, and the same hereby is,
amended by REPEALING Sections 49-1-1 through 49-1-7.
SECTION 5. That Title 14 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, be, and the same hereby is,
amended by REPEALING Sections 14-1-1 through 14-1-13.
SECTION 6. That Title 27 of the Revised Ordinances of Salt
Lake City, Utah, 1965, as amended, be, and the same hereby is,
amended by REPEALING Sections 27-1-1 through 27-1-5 and Sections

SECTION 7. This Ordinance shall take effect 30 days after
