094 of 1985 - Auctions and Auctioneers Y; APPROVED FOR T 0 85-1 "Dili 3��c� ..�. 0 85-42 HLORDER'S OFt LCEJ SALT TAKE CITY ORDINANCE No . 94 of 1985 (Auctions and Auctioneers ) AN ORDINANCE AMENDING CHAPTER 5 OF TITLE 20, OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH 1965, AS AMENDED, RELATING TO AUCTIONEERS AND AUCTIONS, BY ADDING A NEW SECTION 36 RELATING TO EQUIVALENT ALTERNATIVE METHODS OF REGULATION. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Chapter 5 of Title 20 of the Revised Ordinances of Salt Lake City , Utah, 1965, as amended , be, and the same hereby is amended by ADDING a new Section 36, relating to Equivalent alternative methods of regulation to read as follows : Sec. 20-5-36. Equivalent alternative methods of regula- tion. Whenever a person regulated under this chapter alleges that specified requirements of this chapter are impracticable or excessively burdensome as applied to such person, he/she may file with the City License Assessor and Collector a written petition setting forth such allegations and presenting suggested methods of regulation of said person by the City in lieu of enforcement of the specified requirements of this chapter so objected to. The City License Assessor and Collector shall forward a copy of the said petition to the Chief of Police for review. After review , the Chief of Police and the License Assessor and Collector shall recommend to the Mayor either approval or denial of the alternative regulations proposed by the petitioner. The decision as to approval or denial of said proposed alternative regulation( s) shall be made by the Mayor, subject to final approval by the City Council. Upon approval by the Mayor , such alternative regulation( s) shall be as obligatory upon the petitioner as if such had been specific requirements set forth in this chapter, the violation of any of which alternate regulations shall be a misdemeanor. The standard for approval of any such alternative regula- tion( s) shall be that they are equivalent to the requirements of this chapter which they would supplant, in meeting the objectives which underlie this chapter ; namely, inhibiting theft and trafficking of stolen merchandise and providing adequate oppor- tunity for examination by the police of transactions governed by this chapter. SECTION 2. This ordinance shall take effect upon its first publication. Passed by the City Countil of Salt Lake City, Utah, this 20th day of December , 1985.
