010 of 1983 - Establishing Collective Bargaining Procedures for SLC AMENDED BY RESOLUTION 41 of 1984 R 83-4 RESOLUTION NO. 10 OF 1983 Amending Resolution No. 90 of 1978 WHEREAS, on November 16, 1977, the Board of Salt Lake City Commissioners adopted a resolution establishing collective bargaining procedures for Salt Lake City Corporation; and WHEREAS, on February 7, 1978, February 15, 1978, and December 7, 1978, said resolution was amended to clarify and better focus the City's intention with regard to such procedures; and WHEREAS, police sergeants, fire captains and police and fire lieutenants have expressed a desire to be permitted membership in the Employee Organization bargaining for the employees in their respective departments; and WHEREAS, the City recognizes the close comradery and interdependence between these employees and police officers and firefighters due to the necessary reliance on each other when performing hazardous duty and because of parity issues between police and fire ranks; and WHEREAS, these ranks are not strictly supervisory in their nature and scope; therefore, the City, as a matter of public policy, does not oppose the concept of these personnel being permitted to bargain collectively on a limited basis, under the terms of this amended resolution; and WHEREAS, the City is willing to bargain collectively, with Employee organizations including said personnel on employment issues: which do not relate to ( a) employee wages, salaries or economic benefits; or (b) other issues considered to be mangement rights as declared by the City; and WHEREAS, it is not the intent of the City to diminish in any way the management prerogatives reserved to the City under the Collective Bargaining Resolution, or otherwise; and WHEREAS, the City Council desires to amend said Resolution to provide for the above. NOW, THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah, that the Second Amended Labor Bargaining Resolu- tion of December 7, 1978 (Bill No . 90 of 1978) is hereby amended as follows : 1 . Appendix "A" of Bill No. 90 of 1978 is hereby amended to delete the following positions therefrom: captains ( fire ) , lieutenants ( fire ) , lieutenants (police) , and arson investigator. 2. Subsection (a) of Section 10 of Bill No. 90 of 1978 is hereby amended to read as follows : 10. SUPERVISORY, CONFIDENTIAL, SPECIAL EMPLOYEE BARGAINING EXCLUSION; DISCLAIMER; SAVINGS CLAUSE. (a) No supervisory , confidential , elected or special employee as identified on attached Appendix "A" [**and*"B"**] shall be represented by or bargained on behalf of by any Certified Employee Organiza- tion, and no such employee shall be on said Organization 's bargaining team. Further, any -2- Certified Employee Organization as herein defined who shall have membership which includes said excluded employees as identified in attached Appendix "A" [*and*"B"*subsequent*to*December*31 , * 1978*] shall automatically be decertified and; thereafter, no Employee Organization shall be certified who shall have any said employees as members. Police sergeants, arson investigators, fire captains, and police and fire lieutenants may belong to and hold office in an employee organization and the City may bargain with such organization regarding non-economic issues on behalf of such employees, under the following conditions : 1 . No such employee shall serve upon the bargaining team of an employee organization during negotiations with the City on behalf of members of the police or fire unit; and 2 . The City shall not bargain with any employee organization regarding wages or salaries for such employees; nor shall the City bargain on any other benefit for such employees which is determined by the Mayor to be predominantly economic in nature or which has otherwise been determined by the City to be an exclusive management prerogative. No employee described in appendix "A" [**or*"B"**] of this Resolution may vote in any election held hereunder. 3 . All administrative rights and duties assigned to the Board of Salt .Lake City Commissioners under Bill No. 90 of 1978, as amended, are herein assigned to the Mayor.
