RESOLUTION NO. 142 OF 1988
(Amending the subdivision plat of Dunford' s
Subdivision of Block 166, Plat D, pursuant
to Petition No. 400-303-85

WHEREAS, Section 57-5-1, et seq. , Utah Code Annotated,
authorizes the governing body of the City to consider amendments
to existing subdivision plats; and
WHEREAS, such amendments may be made if the Council finds
that neither the public nor any person will be materially injured
by the proposed amendment and further that there is good cause
for such amendment; and
WHEREAS, the Planning Commission, at its meeting on April

25, 1985, recommended approval of the plat amendment; and
WHEREAS, the Council finds that the proposed amendment
reorienting the majority of the lots onto 12th Avenue will make
development of the dwellings easier to deal with in terms of site
grading and construction and further that by allowing the
replatting of the subdivision, the City will obtain over $17, 000
worth of necessary street improvements which will also benefit
the Ensign School operations and the neighborhood and further
that the plat amendment will facilitate developing this
undeveloped two-thirds of the block with low density dwellings
consistent with the Master Plan; and
WHEREAS, the Council believes it appropriate to make such
approval conditional upon the petitioner agreeing to a height 00
limitation of 25 feet on future buildings; and
WHEREAS, notice of the petition to amend was properly cc

mailed to all owners of record of the land contained in the
entire plat, addressed to their mailing addresses appearing on
the roles of the County Assessor of Salt Lake County; and
WHEREAS, the Council has held a public hearing on the
proposed amendment and finds that the statutory grounds have been
met;
NOW, THEREFORE, be it resolved by the City Council of Salt
Lake City, Utah:
1. That the plat amendment as proposed by petitioner is
hereby approved for recording subject to petitioner consenting to
the 25 foot height limitation and all necessary signatures to
accomplish such recording are hereby authorized.
