RESOLUTION NO. 8 OF 2016
A resolution declaring there is a need for the Housing Authority of the County of
Salt Lake to exercise its powers within the boundaries of Salt Lake City.
WHEREAS, the Housing Authority of the County of Salt Lake (the "Authority") was
created pursuant to the provisions of Title 35A, Chapter 8, Part 401, Utah Code Annotated, as
amended (the "Act"); and
WHEREAS, the Act authorizes the Authority to prepare, carry out, and operate projects
and provide for the acquisition, construction, reconstruction, rehabilitation, improvement,
extension, alteration or repair of any project within its area of operation; and
WHEREAS, the Act provides that the Authority's area of operation shall include Salt
Lake City only if a resolution has been adopted by the governing body of Salt Lake City
Corporation (the "City") declaring that there is need for the Authority to exercise its powers
within the boundaries of the City.
WHEREAS, there is a presently a need for the Authority to exercise its powers at a
specific location (the "Project") also known as the Bodhi Apartment Project located at 750 West
South Temple in Salt Lake City.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF SALT
LAKE CITY, UTAH, AS FOLLOWS:
Section 1. Words used in the foregoing recitals shall have the same meanings when
used in the body of this resolution.
Section 2. The City hereby finds, determines and declares that there is a need for the
Authority to exercise its powers within the boundaries of the City in order that the Authority may
provide rental assistance, and prepare, carry out, and operate projects and provide for the
acquisition, construction, reconstruction, rehabilitation, improvement, extension, alteration or
repair of the Project.
Section 3. This resolution shall become effective immediately upon its adoption.
