080 of 1982 - Policy encouraging neighborhood petitions to vacate alleys & fee waiver qualifications `1. R 82-18 RESOLUTION NO. 80 OF 1982 (Policy encouraging neighborhood petitions to vacate alleys - and fee waiver qualifications) WHEREAS, the City Council of Salt Lake City is concerned about the deterioration, neglect, and adverse impact of those alleys presently dedicated for public purposes in residential neighborhoods where the alleys seldom now serve the purposes for which they were originally intended; and WHEREAS, the City Council wishes to reaffirm and protect the City's interest in its public streets, alleys or highways which have been dedicated for public purposes; but WHEREAS, the City Council has determined it is in the best interests of the City to encourage and vacate alleys in resi- dential neighborhoods wherever the alleys are not needed, where vacation is practical, and shall eliminate adverse impacts; and where abutting property owners join in such vacation petitions; and WHEREAS, the City Council would like to encourage neighbor- hoods to prepare and submit neighborhood-supported petitions proposing practical solutions for vacating unnecessary alley ways to eliminate adverse impacts upon the neighborhoods; and WHEREAS, to implement this support, the City Council is willing to provide an incentive of waiving fees already associated with the process of reviewing and considering vacation petitions submitted by neighborhoods dealing solely with the vacation of alleyways for a period to extend until June 30, 1983. NOW, THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah: 1. That the City Council of Salt Lake City, Utah, hereby reaffirms the resolution and policies contained within Resolution 29 of 1978, passed by the former City Commission of Salt Lake City, Utah, on or about the 23rd day of May, 1978. This Resolution specifies the policy, process, and factors requiring identification and consideration of requests to vacate the City's interests in public streets, alleys or highways. 2. That to provide an incentive to encourage neighborhood- supported petitions to alley vacation, the City Council of Salt Lake City, Utah hereby adopts a special fee waiver policy. It is hereby resolved that all petitions requesting the vacation of alleys in residential neighborhoods filed on or before June 30, 1983, shall qualify for a special waiver of the filing fees ($100), but will not apply to a waiver of advertising fees which may be imposed, should a public hearing be required during the review process. (This waiver extends only to those petitions solely involving the vacation of alleyways in residential neighborhoods and shall not apply to any other petitions involving the vacation of alleys within commercial areas nor the vacation and/or closure of streets, etc.) All filing or other related fees involved with the process of considering a petition or request for vacation and/or closure of public ways, streets, or thoroughfares, including filing, advertising, deed preparation, etc., shall remain in full effect for petitions which do not qualify for the waiver. Said fees will also be applicable to any petitions that are not completed and filed with the City on or before June 30, 1982.
