097 of 1983 - Acceptance of Annexation Petition No. 400-60 of 1983 P 83-428 RESOLUTION NO. 97 of 1983 (Accepting Annexation Petition No. 400-60 of 1983, for Purposes of City Council. Review) WHEREAS, Salt Lake City has received a petition for the annexation of approximately 12 ,320 acres of unincorporated territory lying east of Salt Lake City in the vicinity of Emigration Canyon, Salt Lake County, (designated as Petition No. 400-60 of 1983 ) ; and WHEREAS, petitioners appear to constitute the majority of the owners of the assessed real property within the proposed annexation, as shown by the 1982 assessment rolls of Salt Lake County; and WHEREAS, said owners also appear to constitute the owners of at least one-third in value of the assessed real property in the subject area, as shown by said assessment rolls ; and WHEREAS, petitioners have submitted a map of the territory desired to be annexed to the City; and WHEREAS, the territory in question lies contiguous to the corporate limits of Salt Lake City and is within Study Area No . 4, projected for municipal expansion under Salt Lake City ' s Master Policy Declaration, as adopted June 20 , 1979. WHEREAS, it is anticipated that under any annexation of Emigration Canyon, property owners and/or residents within the annexed area will be required to bear all capital costs for services extended by the City , in addition to their proportionate t A share of operational costs for services. NOW, THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City , Utah, that it does hereby: 1 . Accept the petitioner 's petition for annexation for the purpose of considering said annexation, zoning , service demands and costs, and other related matters, and holding public hearings on the proposal . 2 . Request review and hearinq before the Salt Lake City Planning Commission and recommendation by that body. 3 . Direct the City Recorder, upon receipt of recommendation by the Planning Commission, to set a public hearing before the City Council to review the proposed annexation, proposed zoninq classification (s ) , as recommended by the Planning Commission, and proposed Policy Declaration for the area, as it relates to the annexation proposal ; and provide newspaper and mailed notice to petitioners and affected entities at least twenty ( 20 ) days before such hearinq as provided by law. BE IT FURTHER RESOLVED that nothing hereunder shall be con- strued to vest petitioners with rights to reauire annexation of said properties; to bind the City Council to finally approve said annexation; to vest the petitioners with rights to service delivery or to develop under particular zoning , subdivision or site development ordinances; or to require Salt Lake City to exercise jurisdiction over the area, until such time as a decision to annex and extend corporate limits has been made and R -2- w S all annexation formalities have been completed , including the preparation of the final plat according to City Engineer_ specification, appropriate ordinances, annexation agreements and documentation verifying sufficiency of said petition .
