001 of 2024 - Airport Board Ordinance Revisions1 2 SALT LAKE CITY ORDINANCE No. __ of 2024 4 (An ordinance amending Section 2.14 of the Salt Lake City Code, Airport Board, and Subsection 5 2.07.020, City Boards and Commissions Named.) 6 WHEREAS, Section 2.14 of the Salt Lake City Code, creating the Airport Board, 7 requires amendment to align with state law; and 8 WHEREAS, the Salt Lake City Council has reviewed the amendments and determined 9 that adopting this ordinance is in the City's best interests. 10 NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah that: 11 SECTION 1. Amending the Text of Salt Lake City Code Section 2.14. Section 2.14 of 12 the Salt Lake City Code, regarding the Airport Board, is hereby amended as follows: 13 CHAPTER 2.14 14 AIRPORT ADVISORY BOARD 15 16 2.14.010: General Provisions 17 2.14.020: Definitions 18 2.14.030: Creation Of Board 19 2.14.040: Eligibility For Membership 20 2.14.050: Term; Expiration 21 2.14.060: Powers And Duties 22 23 2.14.010: GENERAL PROVISIONS: The provisions of chapter 2.07 of this title shall apply to 24 the airport advisory board except as otherwise set forth in this chapter. 25 2.14.020: DEFINITIONS: 26 In this chapter, the following definitions apply: 27 AIRPORT: All property owned or operated by the city through its department of airports, 28 including the Salt Lake City International Airport, South Valley Regional Airport, Tooele Valley 29 Airport, and any other airport owned or operated by the city. 30 BOARD: The city airport advisory board. 31 BOARD MEMBER: A person appointed by the mayor, with the advice and consent of the 32 council, who is a duly qualified voting member of the board. 01 2 CITY: Salt Lake City, a municipal corporation of the state. 33 COUNCIL: The city council of the City. 34 EXECUTIVE DIRECTOR OF AIRPORTS: The city’s executive director of its department of35 airports. 36 EX OFFICIO MEMBER: A duly qualified and nonvoting member of the board. 37 MAYOR: The duly elected or appointed, and qualified mayor of the city. 38 POLITICAL SUBDIVISION: A county or a municipality in the state. 39 POLITICAL SUBDIVISION REPRESENTATIVE: A voting board member, appointed by a40 qualifying political subdivision. 41 QUALIFYING POLITICAL SUBDIVISION: A city or town in which an extraterritorial42 airport owned and operated by the city is located or, if the airport is not located in a city or town, 43 the county in which the extraterritorial airport is located. 44 2.14.030: CREATION OF BOARD: 45 A. There is created an airport advisory board. The advisory board shall consist of eleven (11) 46 appointed voting board members, with the following composition and limitations: 47 1. One appointed political subdivision representative from each qualifying political48 subdivision, each of whom shall be included in the total number of appointed board49 members. The political subdivision representatives shall be appointed: 50 a. in accordance with an ordinance or policy in place in each qualifying51 political subdivision for appointing individuals to a board, if any; or52b. if no ordinance or policy described in subsection (A)(1)(a) exists, by the53 chief executive officer of the qualifying political subdivision, with advice54 and consent from the legislative body of the qualifying political subdivision. 55 2. Not counting the political subdivision representatives, no more than two (2) board56 members may reside outside the boundaries of Salt Lake City; 57 3. At least one board member must have experience in commercial or industrial58 construction projects with a budget of at least $10,000,000. 59 4. At least one board member must have experience in management and oversight of an60 entity with an operating budget of at least $10,000.000. 61 B. Ex officio members: 62 1. The city council member in whose council district the Salt Lake City International63 Airport is located; and6465 2. The mayor, or the mayor’s designee. 66 3 2.14.040: ELIGIBILITY FOR MEMBERSHIP: 67 To be eligible to be appointed as a board member a person must be: 68 A. Not less than twenty one (21) years of age; 69 B. A resident of the state; and70 C. Not actively engaged or employed in commercial aeronautics. 71 2.14.050: TERM; EXPIRATION: 72 All appointments shall be made for a four (4) year term. A board member may not serve more73 than two (2) four-year terms. 74 2.14.060: POWERS AND DUTIES: 75 The board shall have the following powers and duties: 76 A. The power to determine and establish such rules and regulations for the conduct of the77 board as the board members, and form committees or subcommittees as the board shall deem78 advisable. Such rules and regulations shall not be in conflict with this chapter or other applicable79 city, state or federal law; 80 B. The duty to review airport rules and regulations before adoption by the mayor, and provide81 advice to the mayor about those rules and regulations; 82 C. The right to recommend an individual to be appointed as the executive director of airports; 83 D. The right to be apprised of all major construction and expansion projects for the airport; 84 E. The duty to consider and provide feedback to the executive director on broad matters of85 policy regarding the operation and management of the airport, including the following: 86 1. To provide input amenities at the airport, 87 2. To review and provide feedback on policy regarding the capital improvement88 program of the airport’s master plan study, 89 3. To review and provide feedback on matters regarding problems of general public90 concern affecting the airport, 91 F. To annually review a budget for the operating and maintenance expenditures, before92 approval of the budget by city council; 93 G. The duty to select a chair and vice chair of the board. 9495 4 SECTION 2. Amending the Text of Salt Lake City Code Subsection 2.07.020. 96 Subsection 2.07.020 of the Salt Lake City Code, City Boards and Commissions Named, is97 hereby amended as follows: 98 For the purpose of this chapter the term “city board” or “board” means the following city boards, 99 commissions, councils, and committees: 100 Accessibility and disability commission101 Airport advisory board102 Board of appeals and examiners103 Business advisory board104 Citizens' compensation advisory committee105 City and county building conservancy and use committee106 Community development and capital improvement programs advisory board107 Community recovery committee108 Fire code board of appeals109 Golf enterprise fund advisory board110 Historic landmark commission111 Housing advisory and appeals board112 Housing trust fund advisory board113 Human rights commission114 Library board115 Parks, natural lands, trails, and urban forestry advisory board116 Planning commission117 Public utilities advisory committee118 Racial equity in policing commission119 Salt Lake art design board120 Salt Lake City arts council board121 Salt Lake City sister cities board122 Transportation advisory board123 5 124 SECTION 3. Effective Date.
