HomeMy WebLinkAboutPLNZAD2025-00974 - 176 S 1300 East January 9, 2026 ADMINISTRATIVE INTERPRETATION HISTORIC STATUS DETERMINATION GAS STATION AT 176 SOUTH 1300 EAST DECISION AND FINDINGS PLNZAD2025-00974 REQUEST: This is a request for a historic status determination, initiated by the Planning Director, for the structure located on two properties at 176 South 1300 East (Tax IDs 16-05-230-034-0000 & 16-05-230-033- 0000) in the University Local Historic District and National Register of Historic Places. The purpose of this determination is to address conflicting information in the 2015 Reconnaissance Level Survey (RLS) regarding the historic status of the structure. DECISION: The Zoning Administrator finds that the historic status of the subject structure is “Non-Contributing”. The Zoning Administrator finds that the 2015 RLS classification of “Contributing Structure” was made in error. BACKGROUND: The subject structure is a one-story commercial building (gas station) that was constructed in 1966 and is located in the University Local Historic District. Properties located in a local historic district are subject to the standards of Chapter 21A.34.020 (H Historic Preservation Overlay District) of the Salt Lake City zoning ordinance. The applicable standards of Chapter 21A.34.020 are determined by the historic status rating of the property, either contributing or noncontributing, as identified in the most recent historic resource survey on file with the Salt Lake City Planning Division or a historic status determination issued in accordance with Subsection 21A.34.020.D. Figure 1: Photo of subject structure taken in September 2025. The most recent historic resource survey on file is the 2015 Reconnaissance Level Survey (RLS). The 2015 RLS extended the historic period of the district to 1970. Based on the assessment completed in the 2015 RLS, buildings were given one of the following historic status ratings: • Eligible/Significant (ES) • Eligible/Contributing (EC) • Ineligible/Non-contributing (NC) • Out-of-Period (OP) Contributing buildings include those that are rated ES and EC; Noncontributing buildings include those that are rated NC or OP. Several sections in the RLS indicate the historic status rating of a structure: the map, the photo sheet, and the data sheet. The 2015 RLS notes the historic status rating of the structure as follows: 1. The Map identifies the historic status rating of the subject structure as Ineligible (Noncontributing/NC). 2. The Photo Sheet identifies the historic status rating of the subject structure as EC (Eligible/Contributing). 3. The Data Sheet identifies the historic status rating of the subject structure as EC (Eligible/Contributing). The address in the data sheet is incorrect for the subject structure; it notes 196 South 1300 East instead of 176 South 1300 East. The purpose of this determination is to correct this conflicting information regarding the historic status of the subject structure. ANALYSIS AND FINDINGS: As outlined in 21A.34.020.D, a historic status determination may be rendered using the considerations in subsection 21A.34.020.D.7 for incorrectly rated properties. Staff finds the Ineligible (Noncontributing/NC) historic status identified on the 2015 RLS Map to be the correct status rating of the subject structure, and the rating of EC (Eligible/Contributing) from the photo and data sheets is incorrect. The EC (Eligible/Contributing) rating noted in the photo and data sheets is an error in the survey documentation. As defined in Chapter 21A.62.040, for a building to be considered a “Contributing Structure,” it must retain its historic integrity. Historic integrity is defined in part as “a property’s ability to convey historical associations or attributes.” The gas station does not retain historic integrity because it was significantly modified in 1983 and does not convey historic associations or attributes, and therefore is noncontributing. The subject structure's noncontributing status is also confirmed in the National Register of Historic Places records. The University Historic District was listed on the National Register of Historic Places in 1993. An update to the National Register District was adopted in 2022. This update extended the historic period of the district to 1970 (prior to the update, the historic period was from 1883-1941). The 2022 National Register Nomination Update utilized the documentation collected for the 2015 RLS and provided more information on buildings and historic context from the extended historic period (1942- 1970). The nomination form for the 2022 National Register update specifically calls out the subject structure and its noncontributing status, stating that: “Five of the buildings from the extended period are commercial structures. One comprises a service station, while the remaining four reflect utilitarian commercial forms of simple commercial block structures. One of the commercial buildings exhibits late-1960s Neo- Mansard style, while the rest exhibit modern (out-of-period) styles from the late-20th century due to alterations. None of these commercial structures from this period are considered contributing resources within the district due to these alterations.” The Utah State Historic Preservation Office maintains a Historic Utah Buildings (HUB) map that lists the historic status of the structure as noncontributing. It also includes a note that the incorrect address listed in the 2015 RLS data sheet (196 S 1300 E) refers to the gas station property at 176 S 1300 E. Figure 2: The Historic Utah Buildings map notes that the structure is non-contributing. 21A.34.020.D.7 Considerations for Historic Status Determinations: A historic status determination may include the following considerations: a. Whether alterations that have occurred are generally reversible. b. Whether the building contributes to an understanding of a period of significance of a neighborhood, community, or area. c. Whether or not the building retains historic integrity in terms of location, design, setting, materials, workmanship, feeling and association as defined in Section 21A.62.040. The analysis shall take into consideration how the building reflects the historical or architectural merits of the overall local historic district in which the resource is located. When analyzing historic integrity of a building as part of a local historic district, the collective historic value of the buildings and structures in a local historic district taken together may be greater than the historic value of each individual building or structure in a district. The considerations above may be considered when the integrity of a structure warrants further assessment to determine the historic status. In this case, there is not a question about the structures’ lack of integrity, and reassessment is not necessary. This determination is needed due to a documentation discrepancy. Based on the information above, Staff finds the historic status of the subject structure is “Noncontributing.” CONCLUSION Staff finds that the historic status of the subject structure is “Noncontributing.” As discussed in the analysis and findings section of this determination, other ratings that were noted in the 2015 RLS were made in error. APPEAL PROCESS: An applicant or any other person or entity adversely affected by a decision administering or interpreting this Title may appeal to the Appeals Hearing Officer. Notice of appeal shall be filed within ten (10) days of the administrative decision. The appeal shall be filed with the Planning Division and shall specify the decision appealed and the reasons the appellant claims the decision to be in error.
