HomeMy WebLinkAboutPLNZAD2026-00058 - 1144 S 500 WestFebruary 10, 2026 ADMINISTRATIVE INTERPRETATION DECISION AND FINDINGS PLNZAD2026-00058 REQUEST: This is a request for an administrative interpretation regarding the use and expansion of an existing building to operate as a Place of Worship, Homeless Resource Center, and a Large Group Home. The applicant has requested confirmation that the uses are allowed and that they may occur within the same building. The applicant has also requested confirmation regarding occupancy limits for Homeless Resource Center and Large Group Home uses. The parcel is addressed as 1144 S 500 W (Tax ID# 15-12-304-008-0000). The parcel is located in the MU-11 Mixed Use 11 zoning district. DECISION: Based on the findings below, the Zoning Administrator finds that: 1. A Place of Worship and Large Group Home use are permitted within the MU-11 district, are allowed at the proposed location, and may occur in the same building. 2. A Homeless Resource Center use may occur as part of a Place of Worship use, pursuant to 21A.34.160.D and subject to the provisions of 21A.36.350. 3. A Homeless Resource Center use has a maximum occupancy of 200 unsheltered persons as per 21A.36.350.A.1. 4. There is no maximum occupancy specified in the City Zoning Code for a large group home use. FINDINGS: 1 – Permitted Uses Pursuant to the “Table of Permitted and Conditional Uses” for Mixed-Use Districts (Section 21A.33.030 of the Salt Lake City Code), the following uses, as defined below, are listed as “permitted” uses in the MU-11 zoning and the property owner will not need to obtain a conditional use permit for such use: • Place of Worship: o A church, synagogue, temple, mosque or other place of religious worship, including any accessory use or structure used for religious worship. • Dwelling - Group Home (large): o A residential treatment facility, occupied by seven (7) or more individuals, licensed by the State of Utah under title 62A, chapter 2 of the Utah Code or its successor that provides a twenty four (24) hour group living environment for individuals unrelated to the owner or provider that offers room or board and specialized treatment, behavior modification, rehabilitation, discipline, emotional growth, or habilitation services for persons with emotional, psychological, developmental, or behavioral dysfunctions, impairments, or chemical dependencies. A group home dwelling includes a recovery residence, but does not include a boarding school or foster home as defined in title 62A, chapter 2 of the Utah Code or its successor, or a residential support dwelling as defined in this chapter. There is no standard in Title 21A Zoning that requires the uses be in separate buildings. The uses may be located in the same building, subject to compliance with any other applicable adopted codes, such as Fire or Building code. 2 – Place of Worship and Homeless Resource Center Use Pursuant to the “Homeless Resource Center Overlay District” regulations (Section 21A.34.160.D of the Salt Lake City Code), a place of worship is not required to petition for a zoning map amendment to apply the Homeless Resource Center Overlay Zoning District (Section 21A.50.055 of the Salt Lake City Code), “provided any emergency shelter provided is part of the ecclesiastic function of the place of worship.” The applicable code in 21A.34.160.D is as follows: D. Applicability To Places of Worship. A place of worship is not required to petition for a zoning map amendment to apply this overlay provided any emergency shelter provided is part of the ecclesiastic function of the place of worship. A place of worship that provides emergency shelter to people experiencing homelessness shall comply with the provisions of Section 21A.36.350. As noted, such use must also comply with the applicable regulations in “Standards for Homeless Resource Centers” in Section 21A.36.350 of the Salt Lake City Code. 3 – Homeless Resource Center Occupancy Limit Pursuant to the “Standards For Homeless Resource Centers” regulations (Section 21A.36.350 of the Salt Lake City Code), subsection 21A.36.350.A.1, the capacity limit for a Homeless Resource Center is “two hundred (200) unsheltered persons.” 4 – Group Home Occupancy Limit Pursuant to the “Definitions of Terms” (Section 21A.62.040 of the Salt Lake City Code), there is no maximum occupancy specified in the municipal zoning code for a large group home use. A large group home use is defined as follows: DWELLING, GROUP HOME (LARGE): A residential treatment facility, occupied by seven (7) or more individuals, licensed by the State of Utah under title 62A, chapter 2 of the Utah Code or its successor that provides a twenty four (24) hour group living environment for individuals unrelated to the owner or provider that offers room or board and specialized treatment, behavior modification, rehabilitation, discipline, emotional growth, or habilitation services for persons with emotional, psychological, developmental, or behavioral dysfunctions, impairments, or chemical dependencies. A group home dwelling includes a recovery residence, but does not include a boarding school or foster home as defined in title 62A, chapter 2 of the Utah Code or its successor, or a residential support dwelling as defined in this chapter. The provisions of section 21A.36.360 “Regulations for Shared Housing Use” apply to the separately listed and defined land use “Shared Housing” and do not apply to a “Dwelling, Group Home (Large)” use. 5 – Other Related Occupancy Limits All uses are subject to off-street parking requirements, which can impact the total occupancy or total allowed area of each use. See section 21A.44.040 “Required Off Street Parking” for the required amount of off-street parking per use. Parking requirements can be modified through the provisions of section 21A.44.050 “Alternatives to Minimum and Maximum Parking Calculations.” Other applicable codes and regulations may limit occupancy, such as, but not limited to Public Utility regulations, Fire Code, Building Code, and Utah State Code. APPEAL PROCESS: An applicant or any other person or entity adversely affected by a decision administering or interpreting this Title may appeal to the Appeals Hearing Officer. Notice of appeal shall be filed within ten (10) days of the administrative decision. The appeal shall be filed with the Planning Division and shall specify the decision appealed and the reasons the appellant claims the decision to be in error.
