PLNZAD2022-00360 - 1360 E Perrys HollowJune 17, 2022 ADMINISTRATIVE INTERPRETATION DECISION AND FINDINGS PLNZAD2022-00360 REQUEST: E This is a request for an administrative interpretation regarding whether a proposed structure would be considered a porch and therefore permitted to obstruct the required rear yard per the Obstructions in Required Yards table in Salt Lake City Code Section 21A.36.020.B. The property is located at 1364 E Perrys Hollow Drive (Tax ID: 09-33-103-031-0000). The lot is located within the FR-3 (Foothills Residential) zoning district. DECISION: The Zoning Administrator finds that the proposed structure is considered to be a porch. It would be permitted to obstruct the rear yard by the amount specified in 21A.36.020.B, the Obstructions in Required Yards table. FINDINGS: The property owner has proposed an alteration to the existing house on the property. This project would involve rebuilding and expanding a portion of the rear of the house. Based on the description provided by the applicant, the structure in question would be two levels, unenclosed, with a system of retractable covers on the upper level to provide shade (see attached). Salt Lake City's zoning ordinance does not provide a definition for the term porch. In the absence of a definition, the zoning ordinance requires that staff utilize the provided definition from the Merriam -Webster Dictionary. Merriam -Webster defines a porch as "a covered area adjoining an entrance to a building and usually having a separate roof." The Obstructions in Required Yards table in 21A.36.020.B permits porches (attached, covered, and unenclosed) to project 5 feet or less into a required rear yard. The proposed structure is attached to the main building, unenclosed, and has a removable cover as specified for porches in the table of Obstructions in Required Yards. The proposed structure provides access to a building entrance and its removable cover system is separate from the main building, which aligns with the Merriam -Webster definition. As such, the proposed structure is recognized as a porch and would be permitted to project 5 feet or less into a required rear yard. The appeal shall be filed with the Planning Division and shall specify the decision appealed and the reasons the appellant claims the decision to be in error.
