This letter serves as my determination regarding the legal status of the subject parcel. The parcel has been described in its current configuration, and has been conveyed as such, since at least January 10, 1939 (per a tax sale document noted in Book C24 Page 130 in the Salt Lake County Recorder’s office). Based on that timing, the lot met the minimum lot standards in effect at that time. The city recognizes the current configuration as a legal, complying lot eligible for development and permits. The information used for this determination was all found among the records of the Salt Lake County Recorder’s office, which is the same source used commonly for title reports. Dividing any parcel of land in Salt Lake City into additional parcels or lots, or adjusting of existing parcels, requires review and approval through an applicable city process. The recording of a deed outside of this process does not by itself create a legal parcel/lot. NOTICE: Please be advised that a determination finding a particular use to be a permitted use or a conditional use shall not authorize the establishment of such use nor the development, construction, reconstruction, alteration, or moving of any building or structure. It shall merely authorize the preparation, filing, and processing of applications for any approvals and permits that may be required by the codes and ordinances of the City including, but not limited to, a zoning certificate, a building permit, and a certificate of occupancy, subdivision approval, and a site plan approval. An applicant or any other person or entity adversely affected by a decision administering or interpreting this Title may appeal to the Appeals Hearing Officer. Notice of appeal shall be filed within ten (10) days of the administrative decision. The appeal shall be filed with the Planning Division and shall specify the decision appealed and the reasons the appellant claims the decision to be in error.
