PLNZAD2022-01007 - 233 N ChicagoNovember 21, 2022 ADMINISTRATIVE INTERPRETATION DECISION AND FINDINGS PLNZAD2022-01007 REQUEST: This is a request for an administrative interpretation regarding whether the property located at approximately 233 N Chicago St (Tax ID# 08-35-403-072-0000) is a legal lot and if the existing dwelling on the property is legal in accordance with the Salt Lake City zoning laws. The subject property is located in the R-1-5000 (Single-Family Residential) zoning district. DECISION: The Zoning Administrator finds that the subject property located at approximately 233 N Chicago St is recognized by Salt Lake City as a legal noncomplying lot and may be developed in accordance with the provisions of the R-1-5000 (Single-Family Residential) zoning district, and any other applicable reviews and permits required from other city divisions. The Zoning Administrator also finds that the existing dwelling on the lot is a legally established building. FINDINGS: The subject property does not comply with the standards of the zoning district. The property has a lot area of approximately 31,363 square feet and a lot width of 192.41 feet. The property exceeds the maximum lot area of the R-1-5000 zone of 7,500 square feet. The parcel is not part of a subdivision and it is described as: BEG FR NE COR LOT 3, BLK 69, PLAT C, SLC SUR; W 190 FT; S 165 FT; E 190 FT; N 165 FT TO BEG. Together with the right-of-way over and across the following described property: BEG FR NW COR LOT4, BLK 69, PLAT C, SLC SUR; S 8 FT; E 140 FT; N 8 FT; W 140 FT TO BEG. Based on city and county records, the parcel was created in 2010 through the consolidation of two parcels (08-35-403-065 and 08-35-403-066). The consolidation was approved by the city as stated in PLNSUB2010-00716. The city authorized the consolidation of parcels 08-35-403- 065 and 08-35-403-066 even though the proposed parcel exceeded the maximum lot size because these properties had been created in 1984 without city approval and included a lot without street frontage. The consolidation of the parcels reverted the parcel to its original configuration. According to Sanborn maps and to the county assessor records, the dwelling on this property was built prior to 1927. Building permits were not required prior to 1927, the building is considered legally established. City records also show building permits were issued for improvements to the house. In 1988, the City approved building permit BLD1988-84797 to change the pitch of the roof. In 1981, the City approved building permit BLD1981-7684 for the replacement of the patio, and in 2003 the City approved building permit BLD2003-180053 for the replacement of structure’s windows. APPEAL PROCESS: An applicant or any other person or entity adversely affected by a decision administering or interpreting this Title may appeal to the Appeals Hearing Officer. The appeal shall be filed with the Planning Division and shall specify the decision appealed and the reasons the appellant claims the decision to be in error.
