PLNZAD2022-01198 - 134 S McClellandJanuary 23, 2023 ADMINISTRATIVE DETERMINATION OF NONCONFORMING USE DECISION AND FINDINGS PLNZAD2022-01198 REQUEST: This is a request by Mike Kessler of National Investment Properties for a Determination of Nonconforming use regarding the subject property at 134 S McClelland St (Tax ID # 16-05-204- 020-0000). The applicant is specifically requesting to have the principal building at this address recognized by the City as a legal conforming duplex. The subject property is zoned R-2, which permits two-family dwellings on lots with 8,000 square feet or more in lot area and at least 50 ft of lot width per 21A.24.110. This property has approximately 4,791.6 square feet of lot area and is approximately 39 ft wide and therefore does not comply with the minimum lot requirements for the use. DECISION: The Zoning Administrator finds that the legal use of the principal building at 134 S McClelland St is a single-family dwelling. The use of this property as a duplex was discontinued in 2008 and may not be reestablished under the property’s current zoning designation. FINDINGS: The applicant provided scanned pages of Polk directories dating back to 1955 and as recent as 2021 that list phone numbers for two addresses, 134 S and 136 S McClelland St. While this appears to demonstrate that two units existed prior to 1995 and the property has been continually used as a duplex, the legal use of a duplex was discontinued in 2008 when a previous owner, Donald Kirkpatrick, obtained a building permit to have the property inspected as a single-family home. The City has documentation showing that it was explained to Mr. Kirkpatrick that it would not be possible to convert the property to a duplex in the future since the property does not meet the minimum lot area requirement and chose to move forward with the building permit. Per city records, building permit BLD2008-80410047 was issued to “pour RV pad and obtain inspection to verify building is a single-family home”. The permit was issued on April 10, 2008 and closed July 24, 2008. The attached zoning certificate associated with the building permit confirms that the authorized use of this property is a single-family dwelling. While the documentation provided by the applicant appears to meet the standards of review for unit legalizations in section 21A.38.075 of Zoning Ordinance, definitive City records verify that the use of a duplex at this property was willingly forfeited by a previous owner who was aware that the use could not be reestablished. 21A.38.075 - Standards for Unit Legalization: Any request to approve an existing excess unit must comply with the following: 1. The dwelling unit existed prior to April 12, 1995. In order to determine whether a dwelling unit was in existence prior to April 12, 1995, the unit owner shall provide documentation thereof which may include any of the following: a) Copies of lease or rental agreements, lease or rent payments, or other similar documentation showing a transaction between the unit owner and tenants; b) Evidence indicating that prior to April 12, 1995, the city issued a building permit, business license, zoning certificate, or other permit relating to the dwelling unit in question; c) Utility records indicating existence of a dwelling unit; d) Historic surveys recognized by the planning director as being performed by a trained professional in historic preservation; e) Notarized affidavits from a previous owner, tenant, or neighbor; f) Polk, Cole, or phone directories that indicate existence of the dwelling unit (but not necessarily that the unit was occupied); or g) Any other documentation that the owner is willing to place into a public record which indicates the existence of the excess unit prior to April 12, 1995. 2. The excess unit has been maintained as a separate dwelling unit since April 12, 1995. In order to determine if a unit has been maintained as a separate dwelling unit, the following may be considered: a) Evidence listed in Subsection B.1 of this section indicates that the unit has been occupied at least once every five (5) calendar years; b) Evidence that the unit was marketed for occupancy if the unit was unoccupied for more than five (5) consecutive years; c) If evidence of maintaining a separate dwelling unit as required by Subsection B.1 of this section cannot be established, documentation of construction upgrades may be provided in lieu thereof. d) Any documentation that the owner is willing to place into a public record which provides evidence that the unit was referenced as a separate dwelling unit at least once every five (5) years. We were able to find documentation showing the property has been used as a duplex as far back as 1955 and has continued to be used as such to date. We found the property has also been taxed as a duplex by the county since 1977. When we purchased the property, we assumed it was a duplex as it was taxed this way. We did not think there was an issue with the city as the seller said they used it as a duplex for the entire time they owned the property. We would like to continue to use the property as a duplex, since it is set up this way and is already installed with separate utility meters. Thank you for your consideration.
