PLNZAD2023-00342 - 1361 E 2nd AveJune 6, 2023 ADMINISTRATIVE DETERMINATION OF NONCONFORMING USE DECISION AND FINDINGS PLNZAD2023-00342 REQUEST: Danielle McGuire, property owner, has requested a determination of nonconforming use to legalize a dwelling unit at 1361 E 2nd Ave (Tax ID # 09-33-353-012-0000). The subject property is within the R-1/5,000 zoning district which allows for detached single-family dwellings on properties with at least 5,000 square feet of lot area. This lot is approximately .137 acres or 5,967.72 square feet. DECISION: Based on the review standards listed in 21A.38.075 and the documentation submitted by the applicant, the Zoning Administrator approves the unit legalization at 1361 E 2nd Ave and recognizes the rear building at this property as a single-family dwelling. The determination is subject to the following conditions of approval: 1. The dwelling must comply with all required residential building code requirements as determined by the Building Official or designee. The unit owner shall allow the City’s Building Official or designee to inspect the dwelling unit to determine whether the unit substantially complies with the basic life safety requirements as provided in Title 18, Chapter 18.50, “Existing Residential Housing,” of this code. The inspection can be scheduled by calling the Civil Enforcement division at (801)535-7225 or email civilenforcement@slcgov.com. 2. All required corrections indicated during the inspection process must be completed within one year unless granted an extension by the Zoning Administrator. FINDINGS: The subject property contains a garage and a dwelling unit. The applicant has provided evidence demonstrating that the building containing the dwelling unit was originally constructed prior to zoning laws for an accessory use to a single-family dwelling at 1363 E 2 nd Ave. In 2020, the house on 1363 E 2nd Ave was demolished and the dwelling unit remained on the subject property. The applicant has provided a testimony from a previous property owner (1990 to 2020) which states that the building was used for caregivers for their son, and they were told by the previous owners that the building had always been used as living space.Theapplicant has also provided a notarized affidavit clarifying that that the structure has been occupied at least once every five years since 1995. Planning staff finds that the documentation provided by the applicant meets the standard in 21A.38.075 for Unit Legalizations. 21A.38.075 - Standards for Unit Legalizations: Any request to approve an existing excess unit must comply with the following: 1. The dwelling unit existed prior to April 12, 1995. In order to determine whether a dwelling unit was in existence prior to April 12, 1995, the unit owner shall provide documentation thereof which may include any of the following: a) Copies of lease or rental agreements, lease or rent payments, or other similar documentation showing a transaction between the unit owner and tenants; b) Evidence indicating that prior to April 12, 1995, the city issued a building permit, business license, zoning certificate, or other permit relating to the dwelling unit in question; c) Utility records indicating existence of a dwelling unit; d) Historic surveys recognized by the planning director as being performed by a trained professional in historic preservation; e) Notarized affidavits from a previous owner, tenant, or neighbor; f) Polk, Cole, or phone directories that indicate existence of the dwelling unit (but not necessarily that the unit was occupied); or g) Any other documentation that the owner is willing to place into a public record which indicates the existence of the excess unit prior to April 12, 1995. 2. The excess unit has been maintained as a separate dwelling unit since April 12, 1995. In order to determine if a unit has been maintained as a separate dwelling unit, the following may be considered: a) Evidence listed in Subsection B.1 of this section indicates that the unit has been occupied at least once every five (5) calendar years; b) Evidence that the unit was marketed for occupancy if the unit was unoccupied for more than five (5) consecutive years; c) If evidence of maintaining a separate dwelling unit as required by Subsection B.1 of this section cannot be established, documentation of construction upgrades may be provided in lieu thereof. d) Any documentation that the owner is willing to place into a public record which provides evidence that the unit was referenced as a separate dwelling unit at least once every five (5) years. Single-family dwellings are a permitted use in the R-1/5000 zoning district. The subject building, however, does not comply with current dimensional standards and it is considered a noncomplying structure. Noncomplying structures are buildings that were legally established but do not comply with the applicable yard area, height or bulk regulations of zoning requirements. These structures are allowed to continue to exist. Replacement and modification of such structures may also be permitted according to section 21A.38.050 of the City’s zoning ordinance. To our knowledge, the building ( the "casita/ofﬁce" ) was built when our former home was constructed , which would have been around 1915. In 1998 we were able to conﬁrm that date¬ ¬when, in connection with obtaining a permit to repair the sewer main for the main house, our contractor told us that the only existing sewer permit of record was for the casita. After buying the home in1990, we later learned that two sisters built our respective homes (hence the architectural similarity of the two homes) and the casita, which originally served as a garage and living¬ space for a chauffeur/handyman for both properties which explains the necessity for the original sewer permit and the existing water and electrical hook-ups. The garage was accessible via an alleyway, which now stops at the northwest corner of 1363, but which originally exited east on Military Way, behind both properties. At some point the alley was vacated. The existing three car garage was built in 1987.¬ When we purchased the house we updated the old garage for the use by caregivers for our son, whose medical condition required constant attention. As his condition evolved I began using it as an ofﬁce until the house was destroyed in 2020.
