ADMINISTRATIVE DETERMINATION OF NONCONFORMING USE
DECISION AND FINDINGS

REQUEST:
This is a request for a Determination of Nonconforming Use regarding the property located at
562 S Denver Street (Tax ID# 16-06-454-013-0000). The request is to determine if the
nonconforming use of warehouse can continue. The subject property is zoned RMF-45
Moderate/High Density Multi-Family Residential Zoning District.
DECISION:
Based on the provisions of the Zoning Ordinance section 21A.38.040.E, City records and the
documentation submitted by the applicant, the Zoning Administrator finds that the warehouse
located at 562 S Denver St is considered to be legal nonconforming and allowed to continue.
FINDINGS:
The property located at 562 S Denver St had a building constructed on it initially in 1910 and
was used as a soap factory. In 1948 and 1956, the Board of Adjustment granted approval for
additions to the original soap factory building. In 1957, The Board of Adjustment permitted the
replacement of the building and later 1963, granted another addition.
An Administrative Interpretation issued in 2011 determined that the nonconforming use was
not abandoned, and the City recognized warehousing, light manufacturing and associated uses
as legal nonconforming. In 2011, the property was purchased by Denver Delight and has since
been used as a movie prop warehouse with an office as an accessory use. Electric and water bills
submitted by the applicant support that the property has been used as a warehouse. The electric
bill specifically lists the classification of this property as a warehouse and the water bill classifies
the property as a business.
City records do not show any business licenses associated with the property since it was bought
in 2011. While the previous owners did not require one since the use was being conducted by the
LDS Church for noncommercial purposes, the new owners are required to obtain a business
license to continue operating a business on this property.
Based on the evidence provided, the City recognizes the nonconforming use of warehouse and
accessory use of office on this property. The nonconforming use may continue subject to the
standards of nonconforming uses in 21A.38.040.

APPEAL PROCESS:
An applicant or any other person or entity adversely affected by a decision administering or
interpreting this Title may appeal to the Appeals Hearing Officer. Notice of appeal shall be filed
within ten (10) days of the administrative decision. The appeal shall be filed with the Planning
Division and shall specify the decision appealed and the reasons the appellant claims the
decision to be in error. Applications for appeals are located on the Planning Division website at
https://www.slc.gov/planning/applications/ along with information about how to apply and
processing fees.
