HB 126 MICRO-EDUCATION FACILITY
AMENDMENTS
City must allow micro-education facilities in every zone(existing state code).
•Can limit number of students based on lot size
•Can restrict to certain streets
•Can prohibit in zones where alcohol related land uses are located
•Subject to all other zoning regulations
•May require adding the use to land use tables

HB 215 LANDSCAPE RESTRICTIONS
AMENDMENTS
Prohibits cities from:
•Prohibiting the removal of landscaping in Wildland Urban Interface when
necessary to create defensible space.
•Only impacts properties in WUI Code
•Zoning code already gives precedence to WUI code

HB 597 ALCOHOL AMENDMENTS
Provides modification from spacing requirements if:
•Local consent granted.
•Applies to restaurants and bars in hotels
•Limited to parks, playgrounds, and libraries
•Requires a public hearing prior to local consent

SB 242 TRANSPORTATION AMENDMENTS
SLC Must
•Develop “critical capacity routes map”
•Enter into agreement with UDOT on the map by 1/1/2027
•Adopt agreement into transportation plan and city ordinance
•Categorizes streets into four tiers
•Tier 1: “regionally significant highways” city cannot implement highway
reduction strategy
•Includes UDOT streets and city streets (finalized in routes map)
•Tier 2: may implement highway reduction after

agreement.

Agreement also requires:
•Plans and timeline to mitigate “impacts” of traffic calming on

•200 South (between 300 West and 300 East)
•400 South (West Temple to I-15)

•Can do safety improvement on Tier One
•Does not materially reduce travel capacity or number of vehicle lanes
•Requires study, engagement, UDOT approval
•Maintain width of travel lanes where possible of at least11 feet (applies to Tier 2 as well).
•Tier Three: maintain travel lanes of at least 10 feet
•Cannot reduce on street parking by more than 3 stalls per block unless:
•Public engagement first and inform UDOT
•Report to Transportation Interim Committee by Nov 30, 2027

interpreted to favor the application. (vague language)

An applicant is entitled to approval of a land use application if the application
conforms to the requirements of the applicable land use regulations, land
use decisions, and development standards in effect when the applicant
submits a complete application and pays application fees, unless

UNLESS…
Land use authority finds a compelling, countervailing public interest would be
jeopardized and puts it in writing.
Or, city has started proceedings regarding a land use regulation change that
would prohibit the approval of an application (pending ordinance doctrine or
moratorium).
•City has 180 days to adopt the regulation
•If not, application must be processed
